PUBLIC NOTICE
PLEASE TAKE NOTICE that on the 15th of April, 2026 at 7:30 p.m. the Town of Morristown Zoning Board of Adjustment (the "Board") will hold a public hearing, at Morristown Town Hall, 200 South Street, Morristown, NJ 07960, in the Court/Council Room, regarding the premises located at 39 Hillairy Avenue, Morristown, New Jersey (Block 403, Lot 24, hereinafter the "Property"), located in an MF-1 zone district, on the application made by Applicant Freedom House, at which time and place all interested persons will be given an opportunity to be heard. The Property will be leased by Applicant Freedom House from the Bethel Church of Morristown (formerly known as Bethel A.M.E. Church).
PLEASE TAKE FURTHER NOTICE that this is the third hearing regarding this application. Proper notice was previously provided for this application. This re-notice is being provided as a courtesy due to the Board's decision to change the venue for all meetings from virtual to in-person as of April 1, 2026.
Applicant Freedom House proposes to use the Property containing a pre-existing detached single-family dwelling ("Existing Dwelling") as a residential recovery housing (adult women recovering from substance use disorder, i.e. drug and alcohol abuse) for women being reunited with their children, a rooming house use where such use is otherwise prohibited under the Town of Morristown Land Use Regulations at Section 13-4. The Applicant Freedom House proposes to construct an exterior enclosed stairwell addition at the front of the Existing Dwelling and to install a children's swing set play area at the rear of the Property. The proposed stairwell addition at the front of the Existing Dwelling will be located within the prevailing front yard setback of adjacent dwellings. The Property's improved lot coverage will be increased from 53.98 percent to 54.33 percent (36 square feet) where a maximum improved lot coverage of 40 percent is permitted. In connection with its application, Freedom House seeks a use variance pursuant to N.J.S.A. 40:55D-70d(1), together with a waiver of preliminary and final site plan approval. In addition, Applicant Freedom House reserves the right to seek any and all relief necessary in connection with its application including, but not limited to, any preliminary and final site plan approvals, use and bulk variances, checklist waivers, site plan design exceptions, residential site improvement standards de minimis exceptions or waivers, or other similar relief applicable from the Town of Morristown land use and zoning regulations that the Board may deem necessary in connection with this application.
A copy of the application materials including plans submitted in connection with the application are on file with the Land Use Administrative Officer and may be inspected during regular business hours during the 10 days prior to the meeting at the Morristown Zoning Board Office, Morristown Town Hall, 200 South Street, Morristown, New Jersey 07960 by all interested parties prior to said meeting.
