ORDER TO REHABILITATE OR DEMOLISH, SECURE, CLEAR
NOTICE OF HEARING
4/9/2026
Property Owners (and those holding a substantial property interest in the properties including tax sale buyers) are hereby notified that the building(s) located at the addresses below have been declared by the Building Commissioner to be dangerous structures and/or unfit for human habitation and have been ordered repaired or demolished pursuant to Indiana Code 36-7-9-1 through 28 and City of Muncie Code of Ordinances Title XV, Chapter 152, Division 3, Section 152.15. The order in effect for the properties listed below is listed next to the address. These buildings are ordered to be secured and any trash, debris, fire hazardous materials or public health hazards removed from the premises. The premises must remain secure and clean until such time as the owner has complied with the demolition or repair order. A copy of the repair or demolition order listing deficiencies may be obtained from the Unsafe Building Hearing Authority Administrator. Property owners are required by law to obtain a building permit from the Office of the Building Commissioner prior to beginning rehabilitation work or a Demolition Permit prior to beginning demolition work. Owners must comply with Repair orders or before 4/9/2026. Owners must comply with Demolition orders on or before 5/24/2026.
A hearing relative to these orders will be held on 4/9/2026 for Repair Orders and 4/9/2026 for Demolition orders, unless otherwise indicated below, at 2:00 PM before the Unsafe Building Hearing Authority. The hearing will be held in the City Hall Auditorium on the first floor of City Hall, 300 N. High St., Muncie, IN 47305. You are entitled to appear at the hearing with or without legal counsel, present evidence, cross-examine opposing witnesses and present arguments. If you, or your representative, do not appear at this hearing the matter will be decided in your absence and you may be fined.
If the Unsafe Building Hearing Authority finds there has been willful failure to comply with the order a civil penalty of up to $5000 may be imposed. In addition, the City may contract for performance of the ordered work. The cost of this work and the cost incurred by the City in processing this matter may, if not paid, be recorded as a joint and several debt and lien on all the real and personal property of the persons named and, on all persons, having a fee interest, life estate interest, or equitable interest of a contract purchaser in this unsafe premises. In addition, unpaid costs may be certified by the County Auditor as a special assessment on the tax duplicate of the unsafe premises and collected as delinquent property taxes are collected.
