Project Description:
New York State Electric and Gas Corporation (NYSEG) proposes the replacement of approximately 3,867-feet of 12-inch wrapped steel gas main within their existing pipeline right-of-way (ROW), located between Leon Drive and West Creek and immediately south of Ann McGuinness Elementary School in the Town of Union, Broome County. The proposed work requires 0.06 acres of permanent disturbance within NYS regulated freshwater wetlands and 2.04 acres of temporary disturbances to the associated 100-foot adjacent areas.
NYSEG included a 401 Water Quality Certification application for the proposed discharges of fill within waters of the United States, as well as the corresponding Section 404 permit application to the U.S. Army Corps of Engineers. The project includes the restoration and enhancement of approximately 0.12 acres of forested wetland. Ground disturbance will be minimized using timber mating as well as sediment and erosion control best-management-practices, and the work area shall be restored at the conclusion of construction.

State Environmental Quality Review (SEQR) Determination
Project is not subject to SEQR because it is a Type II action.
SEQR Lead Agency None Designated
State Historic Preservation Act (SHPA) Determination
A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.
DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)
It has been determined that the proposed action is not subject to CP-29.
