MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Daniel Yarnie to Steven A. Ross, Trustee of QS Lending Three Trust, dated October 31, 2023 and recorded on November 1, 2023 with the Worcester County Registry of Deeds in Book 69833, Page 274 of which mortgage the undersigned is the present holder, and in which the mortgaged premises consist of two parcels of land with the buildings and improvements thereon located in Worcester known as 10 Grosvenor Street, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 11:30AM on the 22nd day of April 2026, at the mortgaged premises located at 10 Grosvenor Street, Worcester, Worcester County, Massachusetts, all and singular the premises described in said mortgage.

The land in Worcester, bounded and described as follows:
Parcel I
The land in said Worcester on the southerly side of Lamartine Street and the westerly line of Grosvenor Street.
Beginning at the intersection of the southerly line of Lamartine Street with the westerly line of Grosvenor Street;
Thence southerly along the westerly line of Grosvenor Street eighty-one and four tenths (81.4) feet, more or less, to a point at land now or formerly of one Moore;
Thence westerly by land now or formerly of Moore seventy-four and two tenths (74.2) feet, more or less.
Thence northerly by land now or formerly of Werner and land now or formerly of Cauchon ninety and seventy-two hundredths (90.72) feet, more or less, to a point on the southerly side of Lamartine Street;
Thence easterly by said southerly line of Lamartine Street a distance of seventy-five and four tenths (75.4) feet, more or less to the point of beginning.
Being the same premises conveyed in a deed from Vincent J. Marcelonis to Vincent J. Marcelonis and Doris C. Marcelonis dated May 27, 1987 and recorded in the Worcester District Registry of Deeds in book 10493, Page 54.
Parcel II
BEGINNING at a point located at the northwesterly corner of lot 46, situated on the southerly side of Lamartine Street, said point being about fifty-two and fifty-five hundredths (52.55) feet easterly from the intersection of the easterly line of Lodi Street with the southerly line of Lamartine Street and said point of intersection being located two (2) feet easterly from a Worcester Highway Monument situated two (2) feet westerly from the easterly line of Lodi Street;
Thence southerly, by land now or formerly of Kosta Peter, about ninety-five and twenty-two hundredths (95.22) feet to a point;
Thence easterly, by land now or formerly of Kosta Peter and Mary Gedman et al, about thirty-three (33) feet to a point;
Thence northerly, by land now or formerly of Vincent J. Marcelonis, about ninety and seventy-two hundredths (90.72) feet to a point;
Thence westerly, by Lamartine Street, about thirty-three and fifteen hundredths (33.15) feet to the point of beginning.
Said tract contains about 3,121 square feet and is designated on the Assessor’s Plan Book 5, Page 14, as Lots 46 and 46B.
Being the same premises conveyed in a deed from The City of Worcester to Vincent J. and Doris C. Marcelonis dated February 10, 1970 and recorded in the Worcester District Registry of Deeds in Book 5012, Page 283.
For title see deed recorded with said Worcester District Registry of Deeds in Book 69833, Page 274.
Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid condominium fees, taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed. No representations express or implied are made with respect to any matter concerning the premises, which will be sold “as-is”.
TERMS OF SALE:
Twenty-Five Thousand and 00/100 Dollars ($25,000.00) shall be paid in certified or bank cashier's check by the purchaser at the time and place of said sale, and the balance of the purchase price shall be paid by certified or bank cashier's check at the offices of Erik T. Potter, Esq., Potter MacLellan LLP, 113 Ripley Road, Cohasset, MA 02025 within thirty (30) days from the date of sale. The successful bidder of the sale of the premises shall be required to sign a Memorandum of Terms of Sale containing the above terms at the Auction Sale. The Mortgagee reserves the right to bid at sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The Purchaser shall have no further recourse against the Mortgagor, the Mortgagee, or the Mortgagee’s attorney. The description of the premises contained in said mortgage shall control in the event of an error in this publication.
