MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Daniel Yarnie to Steven A. Ross, Trustee of QS Lending Three Trust, dated February 1, 2023 and recorded on February 1, 2023 with the Worcester County (Southern District) Registry of Deeds in Book 68792, Page 231 of which mortgage the undersigned is the present holder, and in which the mortgaged premises consist of four certain parcels of land with the buildings and improvements thereon located in Oxford known as 2 Leicester Street, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 12:30PM on the 22nd day of April 2026, at the mortgaged premises located at 2 Leicester Street, Oxford (North Oxford), Massachusetts, all and singular the premises described in said mortgage.
To wit:
Four certain tracts of land in Oxford, in the village of North Oxford, bounded and described as follows, with all buildings and structures thereon, including the greenhouse buildings:
TRACT I
The land with the buildings thereon situated at the junction of the Leicester and Worcester Roads, in the northerly part of said Oxford, near Anderson's Store, so-called, and bounded as follows:
BEGINNING at a stone monument set in the ground four feet easterly of an iron pump, northerly of said Leicester Road at land now or formerly of David Taft and being at or near the most southwesterly angle of the tract hereby conveyed;
THENCE N 12°W, one hundred thirty-five (135) feet by land of said Taft to a post near the end of a wall at land now or formerly of Robert Powers;
THENCE easterly two hundred forty (240) feet by land of said Powers and along a stonewall to a point in said wall opposite an iron pipe in the ground on the southerly side of said wall;
THENCE S 3° E, one hundred eighty-eight (188) feet by land of said Powers to an iron pipe in the ground on the westerly side of said Worcester Road near a maple tree;
THENCE southerly by the westerly line of said Worcester Road to the northerly line of said Leicester Road;
THENCE westerly by the northerly line of said Leicester Road to a point opposite the stone bound first mentioned;
THENCE N 12° W, by land of said Taft to the aforementioned stone bound, be the distance what it may.
TRACT II
The land in said Oxford, more particularly bounded and described as follows:
BEGINNING at the southwesterly corner of the tract to be conveyed at an iron pipe driven in the ground, at land formerly of David N. Taft and also being the northwesterly corner of land of Cora M. Brown;
THENCE by land formerly of said Taft, North 11° 07' West, seventy-nine and twenty-five hundredths (79.25) feet to an iron post set in the ground at other land of Robert T. Powers;
THENCE by said land of Powers, North 89° 30' East, one hundred forty-five (145) feet to an iron post set in the ground at land formerly of Francis and Robea Morse;
THENCE by land formerly of Francis and Robea Morse, partly by stone wall, South 48° 05' East, one hundred fourteen and three-tenths (114.3) feet to a corner of walls at land of Cora M. Brown;
THENCE by land of Cora M. Brown, partly by wall, South 89° 30' West, two hundred fourteen and eight-tenths (214.8) feet to the place of beginning.
CONTAINING 13,748 square feet, more or less.
TRACT III
The land in said Oxford, bounded as follows: situated at the junction of the Worcester and Texas Roads,
BEGINNING at an iron pipe in the ground on the northerly side of said Worcester Road at other land of Cora M. Brown;
THENCE S 61° 30' W, 59 5/10 (59.5) feet by said Texas Road to a maple tree on the northerly side of said Texas Road;
Thence N 3° W, 188 feet by land formerly of Robert T. Powers to an iron pipe in the ground at other land of Cora M. Brown;
Thence S 21° 30' E, 171 feet by land of Cora M. Brown to the point of beginning.
CONTAINING 5,076 square feet (The entitled "Worcester Road" is also called Main Street and State Highway, Route 12)
EXCEPT a small tract taken for highway purposes.
TRACT IV
The unimproved parcel shown as Parcel A on a plan of property surveyed for Robert B. Kustigian by Jarvis Land Survey, Professional Land Surveyors, Shrewsbury, Massachusetts and said plan recorded with the Worcester District Registry of Deeds in Plan Book 745, Plan 20 and more particularly bounded and described as follows:
BEGINNING at a point on the northerly side of Main Street, said point being at a distance of 5.85 feet from Mass. Highway bound as shown on said plan;
THENCE N 52° 57' 31" West for a distance of 133.67 feet to a point as shown on said plan;
THENCE S 23° 48' 14" East to a point at Main Street as shown on said plan;
Thence by Main Street for a distance of 78.21 feet as shown on said plan to the point of beginning.
For title see deed recorded with said Worcester County (Southern District) Registry of Deeds in Book 68792, Page 226.
Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid condominium fees, taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed. No representations express or implied are made with respect to any matter concerning the premises, which will be sold “as-is”.
TERMS OF SALE:
Twenty-Five Thousand and 00/100 Dollars ($25,000.00) shall be paid in certified or bank cashier's check by the purchaser at the time and place of said sale, and the balance of the purchase price shall be paid by certified or bank cashier's check at the offices of Erik T. Potter, Esq., Potter MacLellan LLP, 113 Ripley Road, Cohasset, MA 02025 within thirty (30) days from the date of sale. The successful bidder of the sale of the premises shall be required to sign a Memorandum of Terms of Sale containing the above terms at the Auction Sale. The Mortgagee reserves the right to bid at sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The Purchaser shall have no further recourse against the Mortgagor, the Mortgagee, or the Mortgagee’s attorney. The description of the premises contained in said mortgage shall control in the event of an error in this publication.
