By virtue and in execution of the Power of Sale contained in a certain Mortgage given by Marco P. Pimentel to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Province Mortgage Associates, Inc, its successors and assigns, dated May 24, 2013 and recorded in Bristol County Registry of Deeds in Book 10792, Page 121, of which mortgage the undersigned is the present holder by assignment from: Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Province Mortgage Associates, Inc, its successors and assigns to TH MSR Holdings LLC, recorded October 24, 2025 in Book 15333 at page 427, the mortgage was assigned to TH MSR Holdings LLC for breach of the conditions of said Mortgage and for the purpose of foreclosing same will be sold at Public Auction on April 20, 2026 at 12:00PM local time upon the premises 977 Bristol Street, New Bedford, MA 02745, all and singular the premises described in said Mortgage, to wit:
THE LAND IN SAID NEW BEDFORD, TOGETHER WITH THE BUILDINGS THEREON, BOUNDED AND DESCRIBED AS FOLLOWS:
BEGINNING AT THE SOUTHWEST CORNER OF THE LAND TO BE DESCRIBED AT A POINT IN THE NORTHERLY LINE OF BRISTOL STREET DISTANT THREE HUNDRED ONE AND 42/100 (301.42) FEET EASTERLY FROM THE INTERSECTION THEREOF WITH THE EASTERLY LINE OF ACUSHNET AVENUE;
THENCE NORTHERLY IN LINE OF LAND OF PARTIES UNKNOWN NINETY-FIVE AND 14/100 (95.14) FEET TO A POINT FOR A CORNER;
THENCE EASTERLY IN LINE OF LAND OF PARTIES UNKNOWN SEVENTY-NINE AND 80/100 (79.80) FEET TO A POINT FOR A CORNER;
THENCE SOUTHERLY IN LINE OF LAND OF PARTIES UNKNOWN NINETY-FIVE (95)
FEET TO THE NORTHERLY LINE OF BRISTOL STREET; AND THENCE WESTERLY IN SAID NORTHERLY LINE OF BRISTOL STREET SEVENTYTHREE AND 80/100 (73.80) FEET TO THE POINT OF BEGINNING.
BEING SHOWN AS LOTS #658, #660, #662, AND #664 ON A PLAN OF MORRIS PARK, SEC. A, FILED IN THE BRISTOL COUNTY (S.D.) REGISTRY OF DEEDS, IN PLAN BOOK 5, PAGE 47.
The premises are to be sold and conveyed "as is" subject to and with the benefit of all rights, rights of way, easements, restrictions, covenants, encroachments, building and zoning laws, liens, improvements, unpaid taxes, tax titles, water and sewer liens, municipal liens and assessments, and any other encumbrances of record which are in force and applicable having priority over said mortgage whether or not reference to such restrictions, easements, improvements, liens, encumbrances is made in the deed and will be subject to any rights of redemption for unpaid federal taxes, if any, as shall, notwithstanding this provision, constitute valid liens or encumbrances thereon after said sale, rights of tenants and parties in possession, and attorney's fees and costs if any, which take precedence over the said mortgage above described.
TERMS OF SALE: A deposit of FIVE THOUSAND DOLLARS AND 00 CENTS ($5,000.00) in the form of a certified check, bank treasurer's check or money order at the time and place of sale will be required to be Paid by the purchaser in the form of certified funds at the time and place of sale. The Deposit shall be forfeited to the mortgagee if the successful bidder does not comply strictly with the terms of the Memorandum of sale. The balance of the purchase price shall be paid within thirty (30) days from the sale date in the form of a certified funds to Albertelli Law, 5404 Cypress Center Dr., Ste 300, Tampa, FL 33609. A deed will be provided to the purchaser for recording upon receipt of the full purchase price. The Mortgagee reserves the right to bid at the sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. The description of the premises contained in said mortgage shall control in the event of an error in this publication. By order of the present holder of said Mortgage which hereby gives notice of its intention to bid as said sale or at any adjournment or postponement thereof.
