NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain Commercial Mortgage, Security Agreement, Assignment of Leases and Rents and Fixture Filing dated December 12, 2024 given by 167 Union, LLC to RD WAB SPV LLC, said mortgage recorded with the Barnstable County Registry of Deeds in Book 36726, Page 46, and which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 11:00 a.m. on the 24th day of April, 2026 on the mortgaged premises at 7 Collins Lane, Orleans, Massachusetts 02653 (the "Mortgaged Property") all and singular the premises described in said mortgage.

The land together with the buildings thereon situated on Orleans, Barnstable County, Massachusetts, being LOT 11 on a Plan of Land entitled "Subdivision Plan of Land in Orleans, Mass., prepared for David L. Collings, Scale" 1" = 40' Date: Oct 1, 1987, Ryder & Wilcox, Inc. P.E. & R.L.S. So. Orleans Mass.," which plan is recorded with the Barnstable County Registry of Deeds in Plan Book 442, Page 60.
Together with a right of way over Collins Lane, formerly Yong's Lane, as shown on said plan in Plan Book 442, Page 60.
Also granting an easement over the 40' private way leading to Meetinghouse Road, as shown on a plan entitled "Subdivision Plan of Land in Orleans (East), Mass. as surveyed and prepared for Dickinson A. Reed et ux (Esther T.) Scale 1" = 40' April 1973, Schofield Brothers Inc., Registered Professional Engineers & Land Surveyors Orleans and Framingham, Mass." Which plan is recorded with said deeds in Plan Book 275, Page 86, to run with the land conveyed hereunder.
Subject to a prior mortgage to MERS for Mortgageit, Inc. dated May 10, 2007 as the same may have been assigned and recorded with Barnstable Deeds in Book 22025 Page 153.
For title reference, see deed recorded herewith at the Barnstable County Registry of Deeds [Book 36726 Page 44].
The Mortgaged Property will be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens and rights of any tenants and parties in possession, if there be any, or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed. The successful bidder will pay all costs of recording the foreclosure deed and any other foreclosure documents including, without limitation, all state and county excise stamp fees, and shall also be responsible for any Title V inspection and repair requirements.
Terms of sale: A deposit of Twenty-Five Thousand and 00/100 Dollars ($25,000.00) by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check to Mirrione, Shaughnessy & Uitti, LLC, 2 Batterymarch Park, Suite 202, Quincy, MA 02169 within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. In the event of an error in this publication, the description of the premises contained in said mortgage shall control.
