NOTICE OF SHERIFF'S SALE
By virtue of a certified copy of a decree to me, directed from the Clerk of Morgan Superior Court of Morgan County, Indiana, in Cause No. 55D03-2511-MF-002883, wherein Headlands Residential Series Owner Trust, Series H was Plaintiff, and The Unknown Heirs and Devisees of Gloria G. Helton a/k/a Gloria Gay Helton, Deceased and Unknown Successor Trustees of the Helton Family Trust, U/A dated March 21, 2008 were Defendants, required me to make the sum as provided for in said Decree, with interest and cost, I will expose at public sale to the highest bidder on the 11th day of May. 2026, at the hour of 2 p.m., or as soon thereafter as is possible, at 160 North Park Avenue, Martinsville, IN 46151, the fee simple of the whole body of Real Estate in Morgan County, Indiana.
All of the following described real property located in the County of Morgan, State of Indiana. Part of the East Half of the Northeast Quarter of Section 11, Township 11 North, Range 1 East, Morgan County, Indiana, described as follows: Commencing at an iron pin which marks the northeast corner of the above captioned East Half; thence North 88 degrees 12 minutes 01 seconds West (assumed bearing), with the north line of the East Half, 669.28 feet to an iron pin; thence South 03 degrees 58 minutes 01 seconds West, 965.25 feet to an iron pin on the centerline of a fifty (50.00) foot wide access and utility easement and the Point of Beginning of the parcel herein described; thence continuing South 03 degrees 58 minutes 01 seconds West, with the centerline and centerline extended of said easement, 321. 76 feet to an iron pin; thence North 88 degrees 12 minutes 01 seconds West, 677.50 feet to an iron pin on the west line of the East Half of the Northeast Quarter; thence North 03 degrees 58 minutes 01 seconds East, with said west line, 321.76 feet to an iron pin; thence South 88 degrees 12 minutes 01 seconds East, 677.50 feet to the Point of Beginning. Containing 5.001 acres, more or less. a/k/a Part of Parcel #10 Adams Ridge. Together with and Subject to an easement for the purpose of Ingress and Egress, for benefit of Parcel I, as created by Warranty Deed dated July 7, 1993 and recorded July 8, 1993 in Deed Record 357, page 38 over and across the following real estate in Morgan County, Indiana: An access and utility easement (Section 1), Fifty (50) feet in width, Twenty-five (25) feet on each side of centerline, lying in the East Half of the Northeast Quarter of Section 11, Township 11 North, Range 1 East, Morgan County, Indiana, the centerline being described as follows: Commencing at an iron pin which marks the northeast corner of the above captioned East Half; thence North 88 degrees 12 minutes 01 seconds West, with the north line of said East Half, 562.00 feet to an iron pin; thence South 01 degrees 47 minutes 59 seconds West 25.00 feet to the Point of Beginning of the access and utility easement herein described; thence North 88 degrees 47 minutes 59 seconds West 108.22 feet; thence South 03 degrees 58 minutes 01 seconds West 296.73 feet; thence North 88 degrees 12 minutes 01 seconds West 677.50 feet to the west line of the East Half of the Northeast Quarter the same being the east line of a fifty acre parcel described in Deed Record 215, page 271 said parcel being the parent parcel out of which Colonial Hills Subdivision, Third Section, recorded in Deed Record 256, page 82 was taken (it appears that the intent oft he parties was for the east line of Colonial Hills Subdivision, Third Section to be congruent with the east line of the parent fifty acre parcel); thence North 88 degrees 12 minutes 01 seconds West 17.17 feet, onto Lot Number 31 in aforesaid Colonial Hills Subdivision, Third Section; thence North 78 degrees 40 minutes 29 seconds West, through said Lot Number 31, a distance of151.59 feet to the westerly line of said lot and the right-of-way line of the cul-de-sac of Plantation Drive as shown on the plat of Colonial Hills Subdivision, Third Section, said cul-de-sac right-of-way line be the terminus of the easement herein described. Also together with and Subject to an access and utility easement (Section 2), Fifty (50) feet in width, twenty-five (25) feet on each side of centerline, lying in the East Half of the Northeast Quarter of Section 11, Township 11 North, Range 1 East, Morgan County, Indiana, the centerline being described as follows: Commencing at an iron pin which marks the northeast corner of the above captioned East Half; thence North 88 degrees 12 minutes 01 seconds West, with the north line of said East Half, 562.00 feet to an iron pin; thence South 01 degrees 47 minutes 59 seconds West 25.00 feet to the centerline of Access and Utility Easement, Section 1; thence North 88 degrees 47 minutes 59 seconds West, with the center line of said easement, 108.22 feet; thence, continuing with said easement centerline, South 03 degrees 58 minutes 01 seconds West 296.73 feet to an iron pin and the point of beginning of Access and Utility Easement, Section 2; thence South 03 degrees 58 minutes 01 seconds West 857.80 feet to the terminus of the easement.
