AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE CITY OF GOODYEAR, MARICOPA COUNTY, ARIZONA, AMENDING SECTION 9-1-1 (ADOPTION BY REFERENCE) OF ARTICLE 9-1 (TECHNICAL CODES) OF CHAPTER 9 (BUILDINGS AND BUILDING REGULATIONS) OF THE GOODYEAR CITY CODE.

WHEREAS, the Mayor and Council deem it necessary to adopt certain rules and regulations controlling the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use and maintenance of, heating, cooling, ventilating, process piping, refrigerator systems, incinerator or other heat-producing appliance and to adopt certain rules and regulations to regulate the erection, construction, enlargement, alteration, repair, moving, removal, and demolition, conversion, occupancy, equipment, use, height, area and maintenance of all buildings or structures in order to protect the public health, safety and welfare and both public and private property;
WHEREAS, the International Code Council, through a process involving all stakeholders impacted by building construction codes, have developed business construction codes for various aspects of construction including but not limited to residential building codes, building codes, mechanical codes and plumbing codes;
WHEREAS, in addition to the codes adopted by the International Code Council, national industry groups, through a process involving all affected stakeholders, have delivered uniform codes in specific fields such as the National Electric Code;
WHEREAS, these international codes and national codes have been designed to be used nationally across the United States to provide uniformity in the building construction industry;
WHEREAS, uniformity in the building construction codes allows builders to use plans and construction drawings across jurisdictions, thereby facilitating development by saving time and money;
WHEREAS, the uniform codes are supported by organizations such as the Arizona Building Officials, National Association of Homebuilders, FEMA and the American Institute of Architects;
WHEREAS, city staff have reviewed the construction codes for the various aspects of construction including but not limited to residential building codes, building codes, mechanical codes, plumbing codes, gas codes, electric codes and property maintenance codes; and
WHEREAS, amendments to these various standardized codes are needed to address issues specific to the City of Goodyear and to ensure consistency between existing City Ordinances, standard policies and regulations.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF GOODYEAR, MARICOPA COUNTY, ARIZONA, AS FOLLOWS:
SECTION 1. DECLARATION OF PUBLIC RECORDS
That certain document titled “Amendment to Section 9-1-1 of Article 9-1 of Chapter 9 of the Goodyear City Code” a copy of which is attached hereto as Exhibit A, is hereby declared a public record and incorporated herein by this reference.
That certain document titled "2024 International Building Code" including Appendices C, H and O as published by the International Code Council” is hereby declared a public record and incorporated herein by this reference.
That certain document titled "2024 International Mechanical Code" as published by the International Code Council is hereby declared a public record and incorporated herein by this reference.
That certain document titled “2024 International Plumbing Code” as published by the International Code Council is hereby declared a public record and incorporated herein by this reference.
That certain document titled “2024 International Fuel Gas Code” as published by the International Code Council is hereby declared a public record and incorporated herein by this reference.
That certain document titled “2024 International Energy Conservation Code” as published by the International Code Council is hereby declared a public record and incorporated herein by this reference.
That certain document titled “2024 International Existing Building Code” as published by the International Code Council is hereby declared a public record and incorporated herein by this reference.
That certain document titled “2023 NFPA 70 National Electric Code”, including only ANNEXES C and D as published by the National Fire Protection Association is hereby declared a public record and incorporated herein by this reference.
That certain document titled “2017 ICC A117.1 Accessible and Usable Buildings and Facilities” Code as published by the International Code Council is hereby declared a public record and incorporated herein by this reference.
That certain document titled “2010 ADA Standards for Accessible Design” as published by the United States Department of Justice is hereby declared a public record and incorporated herein by this reference.
That certain document titled “2024 NFPA 99 Health Care Facilities Code” as published by the National Fire Protection Association is hereby declared a public record and incorporated herein by this reference.
That certain document titled “2024 International Residential Code” including Appendices BB, BF, BG, CA, CB, CE and CF as published by the International Code Council is hereby declared a public record and incorporated herein by this reference.
That certain document titled “2024 International Property Maintenance Code” as published by the International Code Council is hereby declared a public record and incorporated herein by this reference.
Either three (3) paper copies or one (1) paper copy and one (1) electronic copy, maintained in compliance with A.R.S. 44-7041, of the aforementioned documents being declared public records herein is ordered to remain on file with the City Clerk and to be available for public use and inspection during regular business hours.
SECTION 2. AMENDING SECTION 9-1-1 OF ARTICLE 9-1 OF CHAPTER 9 OF THE GOODYEAR CITY CODE:
Section 9-1-1 of Article 9-1 of Chapter 9 of the Goodyear City Code is hereby deleted in its entirety and amended as set forth in that certain document titled, “Amendment to Section 9-1-1 of Article 9-1 of Chapter 9 of the Goodyear City Code” which is attached to this Ordinance 2026-1646 as Exhibit A, and is declared a public record, a copy of which is on file with the City Clerk of the city of Goodyear in compliance with A.R.S. 44-7041 and which is referred to, adopted and made a part hereof as if fully set forth in this Ordinance.
SECTION 3. REPEAL OF ORDINANCE NO. 2019-1437
Ordinance No. 2019-1437 is hereby repealed as of the effective date of this Ordinance No. 2026-1646. The repeal of this ordinance does not affect the rights and duties that matured or penalties that were incurred and proceedings that were begun before the effective date of the repeal.
SECTION 4. IMPLEMENTATION
The codes and amendments thereto adopted by this Ordinance 2026-1646, shall apply to all applications for building permits submitted on or after the effective date of this Ordinance 2026-1646 except as provided herein:
A. Applications for permits submitted for review will be reviewed using the building construction codes in effect at the time of submittal.
1. Subdivisions will not be treated as a whole for purposes of the application of construction building codes. Depending on the application dates, some houses may be under construction using the building construction codes and amendments adopted by Ordinance 2019-1437.
B. Standard home plans approved under the building construction codes and amendments adopted thereto by Ordinance 2019-1437 will remain valid until one (1) year following the effective date of this Ordinance 2026-1646 and shall expire thereafter.
C. To prevent unnecessary delays and costs related to redesigns, for a period of ninety (90) days after the effective date of this Ordinance 2026-1646 all commercial and/or industrial projects may request to have the project reviewed using the building construction codes and amendments thereto adopted by Ordinance 2019-1437.
D. All permits issued under the building construction codes and the amendments thereto adopted by Ordinance 2019-1437 that have expired (no work within 180 days after issuance), must comply with this Ordinance 2026-1646 and the codes adopted herein prior to being renewed or reissued.
SECTION 5. CORRECTIONS
The City Clerk and his/her designee, the City Attorney and his/her designee, and the codifiers of this ordinance are authorized to make necessary clerical corrections to this ordinance including, but not limited to, the correction of scrivener’s/clerical errors, references, ordinance numbering, section/subsection numbers and any references thereto.
SECTION 6. SEVERABILITY
If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions of this Ordinance or parts thereof.
SECTION 7 EFFECTIVE DATE
This ordinance shall become effective at the time and in the manner prescribed by law.
SECTION 8. RECORDATION
This Ordinance shall be recorded with the Maricopa County Recorder’s Office.
PASSED AND ADOPTED by the Mayor and Council of the City of Goodyear, Maricopa County, Arizona, by a 7-0 vote, this 23rd day of March, 2026.
