LEGAL NOTICE
MORTGAGEE’S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Deborah A. Sanborn and Wayne E. Sanborn to Bank of America, N.A. dated December 13, 2004 and recorded with the Plymouth County Registry of Deeds, in Book 29681, Page 277, as affected by Loan Modification Agreement dated October 5, 2020 and recorded with said Registry in Book 53994, Page 57, as assigned by Assignment of Mortgage dated May 19, 2016; recorded in Plymouth County Registry of Deeds, Book 47020, Page 131, and by Assignment dated April 12, 2018; recorded in Plymouth County Registry of Deeds, Book 49725, Page 36, and by Assignment dated September 23, 2021; recorded in Plymouth County Registry of Deeds, Book 55876, Page 282, and by Assignment dated October 27, 2021; recorded in Plymouth County Registry of Deeds, Book 56020, Page 228, of which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 11:00 AM on April 24, 2026, on the premises known as 156 North Main Street, Middleboro, Massachusetts the premises described in said mortgage, together with all the rights, easements, and appurtenances thereto, to wit:
The land with the buildings thereon, situated on the Northerly side of North Main Street, Middleborough, Plymouth County, Massachusetts and more particularly bounded and described as follows:
Beginning at the northeasterly corner of land formerly of Peter H. Peirce, next to the street leading from the Four Corners to the dwelling house of Horatio G. Wood, now known as North Main Street in said Middleborough;
Thence North 40 and one half degrees East by said Street, a distance of 66 feet to a stake; Thence North 50 degrees West a distance of 189.75 feet to a stake; Thence South 40 degrees West a distance of 82.5 feet to a said land formerly of Peter H. Pierce; Thence in line of said 1 and formerly of Peirce, South 56 degrees West to the bound and corner first mentioned.
Containing 55 rods, more or less.
Also, a certain piece of land situated in said Middleborough, on the Westerly side of the above-described houselot bounded and described as follows:
Beginning at the Northerly corner of the above-described houselot; Thence North 50 degrees West about 214.50 feet to land formerly of Jonathan K. Peckham, said line being the same point of compass as the Northerly line of said above-described houselot; Thence Southerly in the line of said Peckham’s land about 99 feet to the land formerly of Ellisha Tucker; Thence Easterly in the line of said Tucker’s land and the land formerly of Peter H. Peirce to the corner of said above-described houselot 82.5 feet to the place of beginning.
Containing 75 rods, more or less.
Being the same premises conveyed to the herein named mortgagor(s) by deed recorded with Plymouth County Registry of Deeds in Book 8421, Page 158.
Terms of Sale: These premises are being sold subject to any and all unpaid real estate taxes, water rates, municipal charges and assessments, condominium charges, expenses, costs, and assessments, if applicable, federal tax liens, partition wall rights, statutes, regulations, zoning, subdivision control, or other municipal ordinances or bylaws respecting land use, configuration, building or approval, or bylaws, statutes or ordinances regarding the presence of lead paint, asbestos or other toxic substances, sanitary codes, housing codes, tenancy, and, to the extent that they are recorded prior to the above mortgage, any easements, rights of way, restrictions, confirmation or other matters of record.
The purchaser shall also bear all state and county deeds excise tax. The deposit of $10,000.00 is to be paid in cash or bank or certified check at the time and place of the sale, with the balance of the purchase price to be paid by bank or certified check within forty-five (45) days after the date of the sale, to be deposited in escrow with Guaetta and Benson, LLC, at 73 Princeton Street, Suite 208, North Chelmsford, Massachusetts.
In the event that the successful bidder at the foreclosure sale shall default in purchasing the within described property according to the terms of this Notice of Sale and/or the terms of the Memorandum of Sale executed at the time of the foreclosure, the Mortgagee reserves the right to sell the property by foreclosure deed to the second highest bidder or, thereafter, to the next highest bidders, providing that said bidder shall deposit with said attorney, the amount of the required deposit as set forth herein within five (5) business days after written notice of the default of the previous highest bidder.
Other terms, if any, are to be announced at the sale.
