NOTICE OF SALE UNDER POWER IN SECURITY DEED
STATE OF GEORGIA COUNTY OF CHATHAM
Under and by virtue of the Power of Sale contained in the Deed to Secure Debt dated as of March 12, 2025, from 318 WILLIAMSON STREET LLC (the “Grantor”) to WESTMOORE LENDING PARTNERS III, LLC (the “Lender”), recorded in Deed Book 3615, page 166, Chatham County Georgia records, (the “Security Deed”) the undersigned will sell at public outcry to the highest and best bidder for cash before the door of the Courthouse of Chatham County, Georgia, during the legal hours of sale, on the first Tuesday in May 2026 (i.e., May 5, 2026), the following described real and personal properties located in Chatham County, Georgia (together, the “Property”), to wit:
All those tracts or parcels of land lying and being in the County of Chatham, State of Georgia, and is described as follows:
PARCEL ONE:
All that certain lot, tract or parcel of land situate, lying and being in the City of Savannah, Chatham County, Georgia, and being known as LOT SEVENTEEN (17), NEW FRANKLIN WARD, as the same is shown on a map or plat in the records of the City Engineer of said City in a Book of Plats commonly known as the "West Book," Page 204; said lots having a frontage of 90.15 feet on the North side of Williamson Street with a western depth of 54.20 feet on the Eastern edge of an unopened portion of Montgomery Street right-of-way, and an Eastern depth of 33 feet; said lot being more particularly described as follows: Beginning at an old concrete monument at the point of intersection of the Eastern right-of-way line of an unopened portion of Montgomery Street and the Northern right-of-way line of Williamson Street, said point also being the Southwestern corner of the property herein described; running thence North seventeen degrees zero minutes East (N 17° 00' E) along the unopened right-of-way line of Montgomery Street for a distance of 54.20 feet to a point marked with an old iron pipe; running thence South sixty degrees four minutes thirty seconds East (S 60° 04' 30" E) for a distance of 92.19 feet to a point, said point being South sixteen degrees thirty minutes twenty seconds West (S 16° 30' 20" W) 4.84 feet from a nail in the concrete footing for a retaining wall; running thence South sixteen degrees thirty minutes twenty seconds West (S 16° 30' 20" W) for a distance of 33 feet to a stake located on the Northern edge of the right-of-way of Williamson Street; running thence North seventy-three degrees twenty-four minutes West (N 73° 24' W) along the Northern edge of the right-of-way of Williamson Street for a distance of 90.15 feet to an old concrete monument and the Point of Beginning; the same being Parcel 1 as conveyed to Mack A. Scott by William Bauer by warranty deed dated January 4th, 1967, as recorded in the Office of the Clerk of the Superior Court of Chatham County, Georgia, in Deed Record Book 91-l's, Folio 383; for a more particular description of said lot reference is hereby made to a certain plat of survey prepared by Sewell & Associates, Inc. for Mack A. Scott dated February 1, 1968, and recorded in the Office of the Clerk of the Superior Court of Chatham County, Georgia, in Map or Plat Record Book S, Folio 150; said lot containing thereon a certain three-story building known as 318 and 320 Williamson Street, according to the present numbering system of the City of Savannah.
PARCEL TWO:
All that certain portion of lot situate, lying and being in New Franklin Ward, in the City of Savannah, Chatham County, Georgia, adjacent to and East of Lot 17, said Ward, having a frontage of Eight and forty-three one-hundredths (8.43) feet on the Northern side of Williamson Street, as shown on a plat of a portion of area for ingress and egress to Wharf Lot 14, New Franklin Ward, Savannah, Georgia, made by Barrett & Exley, Inc., dated September 8, 1977, and being more fully described as follows: Commencing at a point where the Eastern right-of-way line of Montgomery Street intersects the Northern right-of-way line of Williamson Street; from said point thence South 68° 57' 40" East a distance of Ninety and fifteen one-hundredths (90.15) feet to a point which is marked by an "X" in concrete, which point is the Point of Beginning; thence North 16° 30' 20" East Thirty-three and sixteen one-hundredths (33.16) feet to a point, thence South 55° 43' 30" East Nine and eighty one-hundredths (9.80) feet to a point, thence South 18° 13' 50" West Thirty and eighty-five one-hundredths (30.85) feet, to a nail in concrete marking the Northern right-of-way line of said Williamson Street, thence North 68° 57' 40" West a distance of Eight and forty-three one-hundredths (8.43) feet along said right-of-way line to the Point of Beginning. Said portion of lot being shown on a plat thereof prepared by Barrett & Exley, Inc., dated September 8, 1977, a copy of which is attached hereto and expressly made a part hereof, and also being a portion of the property designated "area for ingress and egress to Wharf Lot 14" on that certain survey map or plat prepared by Sewell and Associates, Inc. for Mack A. Scott, dated February 1, 1968, and recorded in the Office of the Clerk of the Superior Court of Chatham County, Georgia, in Plat Book S, Page 150. Said portion of lot being the same property described in that certain deed from Hugh H. Jackson, Jr. to Mack A. Scott, dated October 21, 1977, recorded in said Clerk's Office in Deed Book 109-M, Page 138, and being a portion of the same property described in those certain deeds recorded in said Clerk's Office in Deed Books 91-1, Page 383, 102-1, Page 75, and 103-E, Page 871.
PARCEL THREE:
All that certain lot, tract or parcel of land situate, lying and being in Savannah, Chatham County, Georgia, within New Franklin Ward, and being a portion of an abandoned unused portion of the right-of-way of Factors Walk lying immediately to the North of and adjacent to Lot 17, New Franklin Ward (being Parcel 1 hereinabove described), and being more particularly described as follows: Commencing at an old concrete monument located at the Northeast corner of the intersection of Williamson Street and the unopened right-of-way of Montgomery Street; running thence North seventeen degrees zero minutes East (N 17° 00' E) along the Eastern edge of said unopened right-of-way, being the Western boundary line of Lot 17, New Franklin Ward, for a distance of 54.20 feet to an old iron pipe located at the Northwest corner of Lot 17, New Franklin Ward, being the Point of Beginning; running thence North seventeen degrees zero minutes Est (N 17° 00' E) along the Eastern edge of the unopened right-of-way of Montgomery Street for a distance of 15.29 feet to an old concrete monument; running thence South fifty-three degrees fifty-five minutes East (S 53° 55',E) for a distance of 95.04 feet to a nail in the concrete footing for an existing brick retaining wall; running thence South sixteen degrees thirty minutes twenty seconds West (S 16° 30' 20" W) for a distance of 4.84 feet to a point, which point is located at the Northern corner of Lot 17, New Franklin Ward (being Parcel 1 as hereinabove described); running thence North sixty degrees four minutes thirty seconds West (N 60° 04' 30" W) along the Northern boundary line of Lot 17, New Franklin Ward, for a distance of
92.19 feet to the Point of Beginning; said portion of the right-of-way of Factors Walk, as herein described, being shown as
"undesignated area" on a certain ma or plat prepared by Sewell & Associates, Inc. for Mack A. Scott, dated February 1, 1968, and recorded in the Office of the Clerk of the Superior Court of Chatham County, Georgia, in Map or Plat Record Book S, Folio 150; said strip of land being Parcel 3 as conveyed to Mack A. Scott by William Bauer by warranty deed dated January 4th, 1967, as recorded in the Office of the Clerk of the Superior Court of Chatham County, Georgia, in Deed Book 91-l's, Folio 383.
All of the three (3) above-mentioned parcels of land lie contiguous and form one tract of land; Parcels 1 and 3, as above-described, being shown on that certain survey map or plat prepared by Sewell & Associates, Inc. for Mack A. Scott, dated February 1, 1968, and recorded in the Office of the Clerk of the Superior Court of Chatham County, Georgia, in Map or Plat Record Book S, folio 150, which map or plat, by this reference is incorporated herein and made a part hereof; Parcel Number 2, as above described, being not delineated on said recorded map or plan but being a portion of the land shown on said plat lying immediately East of Parcels Numbered 1 and 3.

TOGETHER WITH all easements, rights-of-way, strips and gores of land, streets, ways, alleys, passages, sewer rights, waters, water courses, water rights and powers, and all estates, rights, titles, interests, minerals, royalties, easements, privileges, liberties, tenements, hereditaments and appurtenances whatsoever, in any way belonging, relating of appertaining to the Property or any part thereof, or which hereafter shall in any way belong, relate or be appurtenant thereto, whether now owned or hereafter acquired by Borrower and the reversion and reversions, remainder and remainders thereof.
The debt secured by the Security Deed is evidenced by a Note executed by 318 WILLIAMSON STREET LLC (“Borrower”) in favor of Lender, dated on or about March 12, 2025 in the original principal amount of $835,000.00, and currently held by Lender (the “Note”), plus interest from that date on the unpaid balance until paid.
Default has occurred and continues under the terms of the Note and Security Deed by reason of, among other possible events of default, the nonpayment when due of the indebtedness evidenced by the Note and secured by the Security Deed. By reason of this default, the Security Deed has been declared foreclosable according to its terms. The above-described real property will be sold to the highest and best bidder for cash as the property of Grantor, the proceeds to be applied to the payment of said indebtedness, attorneys' fees, and the lawful expenses of said sale, all as provided in the Note and Security Deed. The sale shall be subject to the following: all outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable); the right of redemption of any taxing authority; any matters which might be disclosed by an accurate survey and inspection of the property; and any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and any matters of record superior to the Security Deed.
The sale will be conducted subject (1) to confirmation that the sale is permitted by any applicable court; and (2) to final confirmation and audit of the status of the loan with the holder of the Security Deed.
Notice has been given of intention to collect attorney's fees in accordance with the terms of the Note secured by said Security Deed. Notice of this sale has been given to the Grantor pursuant to O.C.G.A. Section 44-14-162 et seq.
To the best of the undersigned's knowledge and belief, the real property is presently owned by 318 WILLIAMSON STREET LLC. To the best of the undersigned's knowledge and belief, the party in possession of the real property is 318 WILLIAMSON STREET LLC.
