ORDINANCE NO. 3155 BY: Ald. Marshall AN ORDINANCE TO AMEND SUBSECTION 17.0505(d) OF THE MUNICIPAL CODE PERTAINING TO TREE PRESERVATION. The Common Council of the City of Oak Creek does hereby ordain as follows: SECTION I. Table 17.0505(d)(4) of the Municipal Code is hereby amended to read: Table 17.0505(d)(4) Tree Replacement Rate Caliper of Tree to be Removed (inches) – Number of Replacement Trees Required 12 to 29 –-- 2 30 or greater ---- 3 SECTION II. Subsection 17.0505(d)(5) of the Municipal Code is hereby created to read: (d) Tree preservation. * * * (5) If it is determined that the tree replacement requirements outlined in Table 17.0505(d)(4) are not feasible after conducting the required tree preservation and removal plan, the developer may present an alternative that meets the intent of the Tree Preservation requirements to the Common Council for consideration. SECTION III. The terms and provisions of this ordinance are severable. Should any term or provision of this ordinance be found to be invalid by a court of competent jurisdiction, the remaining terms and provisions shall remain in full force and effect. SECTION IV. All ordinances or parts of ordinances contravening the provisions of this ordinance are hereby repealed. SECTION V. This ordinance shall take effect and be in force from and after its passage and publication.
