TOWN OF YARMOUTH ZONING BOARD OF APPEALS
You are hereby notified that the Yarmouth Zoning Board of Appeals will hold a public hearing on the following petitions/appeals on Thursday, April 23, 2026 at 6:00 p.m. at Yarmouth Town Hall, 1146 Route 28, South Yarmouth, MA 02664 in the Select Board’s Hearing Room.
PETITION 5226: Kiley Owen. Property Location: 189 Center Street, Yarmouth Port, MA. Map & Lot #: 140.34. Zoning District: R-40. The Applicant seeks a Variance from §202.5 for H-11 Use (Miscellaneous Retail) to hold a one-day event for the display and sale of local artists’ work. The Applicant requests a waiver from the requirement for a certified site/plot plan less than two years old.
PETITION 5227: Donna Anderson, 71 Witchwood Road, South Yarmouth, MA. Map & Lot #: 68.86. Zoning District: R-40, APD, Zone II. The Applicant seeks a Special Permit per §104.3.2, Paragraph 2 and/or a Variance from Table 203.5 for side setback relief to construct an addition to an existing ~157 square foot shed.
PETITION 5228: Cape & Islands Signs. Property Location: 121 Route 6A, Yarmouth Port, MA. Map & Lot #: 121.87.1. Zoning District: R-40 & B-1. The Applicant seeks a Special Permit per §303.13 and/or a Variance from §303.5.5.2 to allow an attached sign, which exceeds the maximum height, to remain. The Applicant requests a waiver from the requirement for a certified site/plot plan less than two years old.
PETITION 5229: Lourival Santos dba Lourival Masonry LLC. Property Location: 96 South Shore Drive, South Yarmouth, MA. Map & Lot #: 19.94; Zoning District: R-25. The Applicant seeks a Special Permit per §104.3.2(2) to increase the ridge height of a preexisting nonconforming structure.
The meeting will be held at Yarmouth Town Hall, 1146 Route 28, South Yarmouth, MA. Remote participation will also be available. Specific information for participation by members of the public and/or parties with a right and/or requirement to attend this meeting can be found within the posted agenda on the town’s website at https://www.yarmouth.ma.us/AgendaCenter at least 48 hours in advance of the meeting.
