NOTICE OF SALE UNDER POWER
Pursuant to the power of sale contained in the Security Deed executed by VIVIAN W. TERRELL to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., AS GRANTEE. AS NOMINEE FOR GEORGIA BANK & TRUST COMPANY OF AUGUSTA in the original principal amount of $83,050.00 dated July 20, 2004, and recorded in Deed Book 273G, Page 92, Chatham County records, said Security Deed being last transferred to SELENE FINANCE, LP in Deed Book 3699, Page 496, Chatham County records, the undersigned will sell at public outcry to the highest bidder for cash, before the Courthouse door in said County, or at such other place as lawfully designated, within the legal hours of sale, on 5/5/2026, the property in said Security Deed and described as follows:
ALL THOSE CERTAIN LOTS, TRACTS, OR PARCELS OF LAND SITUATE, LYING AND BEING IN THE STATE OF GEORGIA, AND COUNTY OF CHATHAM AND BEING KNOWN UPON A PLAN OF LIBERTY CITY, A SUBDIVISION OF LANE, AS PREPARTED BY MARMADUKE H. FLOYD, C.E., FOR THE LIBERTY CITY ASSOCIATES, OF RECORD IN SUBDIVISION MAP BOOK A, FOLIO 84 IN THE OFFICE OF THE CLERK OF THE SUPERIOR COURT OF CHATHAM COUNTY, GEORGIA, AS LOTS TEN (10) AND ELEVEN (11), BLOCK FIVE (5); SAID TWO (2) LOTS LYING CONTIGUOUS AND BEING SITUATED AT THE SOUTHWESTERM INTERSECTION OF 55TH STREET AND LIBERTY PARKWAY AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT THE SOUTHWESTERN INTERSECTION OF 55TH STREET AND LIBERTY PARKWAY, WHICH POINT IS THE NORTHEASTERN CORNER OF THE PARCEL OF LAND HEREIN DESCRIBED AND ALSO THE POINT OF BEGINNING; THENCE IN A SOUTHERN DIRECTION ALONG THE WESTERN SIDE OF LIBERTY PARKWAY A DISTANCE OF ONE HUNDRED (100) FEET TO A POINT; THENCE IN A WESTERN DIRECTION ALONG THE DIVIDING LINE BETWEEN LOTS TEN (10) AND ELEVEN (11) AND LOTS TWNETY-ONE (21) AND TWENTY-TWO (22), SAID BLOCK AND SUBDIVISION, A DISTANCE OF ONE HUNDRED (100) FEET TO 55TH STREET; THENCE IN AN EASTERN DIRECTION ALONG THE SOUTHERN SIDE OF 55TH STREET A DISTANCE OF ONE HUNDRED TWENTY (120) FEET TO THE POINT OF BEGINNING; SAID TWO (2) LOTS AS A WHOLE BEING BOUNDED ON THE NORTH BY 55TH STREET, ON THE EAST BY LIBERTY PARKWAY; ON THE SOUTH BY LOTS TWENTY-ONE (21), AND TWENTY-ONE (22), SAID BLOCK AND SUBDIVISION, ON THE WEST BY LOT NINE (9), SAID BLOCK AND SUBDIVISION.
THIS BEING THE SAME PROPERTY CONVEYED BY OCTOBER 11, 1961 FROM JOHN L. GRESHAM TO FRANCES THOMPSON GRESHAM AND RECORDED IN THE OFFICE OF THE CLERK OF SUPERIOR COUTY OF THE CATHAM COUNTY, GEORGIA IN DEED RECORD BOOK 79-D, PAGE 67.
Said property being known as: 1901 LLOYD ST, SAVANNAH, GA 31405
To the best of the undersigned’s knowledge, the party or parties in possession of said property is/are VIVIAN W. TERRELL or tenant(s).
The debt secured by said Security Deed has been and is hereby declared due and payable because of, among other possible events of default, failure to pay the indebtedness as provided for in the Note and said Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of sale, including attorney’s fees (notice of intent to collect attorney’s fees having been given).
Said property will be sold subject to the following: (1) any outstanding ad valorem taxes (including taxes which are a lien, whether or not yet due and payable); (2) the right of redemption of any taxing authority; (3) any matters which might be disclosed by an accurate survey and inspection of the property; and (4) any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
Said sale will be conducted subject to the following: (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the status of the loan with the holder of the Security Deed.
