This is an attempt to collect a debt, and any information obtained will be used for that purpose.
Attention homeowner: If you are a military service member on active duty, if you period of active duty has concluded less than 90 days ago, or if you have been ordered to active duty, please contact the attorney for the party foreclosing the mortgage at the telephone number stated in this notice.
Default has occurred in the conditions of a mortgage made by ROBERT J. FONES, a single person, Mortgagor, to INDEPENDENT BANK SOUTH MICHIGAN, a Michigan banking corporation, having its principal office at 4200 East Beltline, Grand Rapids, MI 49525, Mortgagee, dated April 8, 2003 and recorded April 18, 2003 in Liber 1662 of Mortgages, Page 45 and re-recorded November 4, 2003 in Liber 1760, on Page 1179. By reason of such default the undersigned elects to declare the entire unpaid amount of said mortgage due and payable forthwith.
Notice of Foreclosure By Advertisement. Notice is given under Section 3212 of the Revised Judicature Act of 1961, 1961 PA 236, MCL 600.3212, that the following mortgage will be foreclosed by a sale of the mortgaged premises, or some part of them, at a public auction sale to the highest bidder for cash or cashier's check at 1045 Independence Blvd., Charlotte, MI 48813, the place of holding the Circuit Court in Eaton County, starting promptly at 10:00 a.m., on May 21, 2026. The amount due on the mortgage may be greater on the day of the sale. Placing the highest bid at the sale does not automatically entitle the purchaser to free and clear ownership of the property. A potential purchaser is encouraged to contact the County Register of Deeds Office or a title insurance company, either of which may charge a fee for this information. Notice is hereby given that by virtue of the power of sale contained in said mortgage and under section 3212 of the revised judicature act of 1961, 1961 PA 236, MCL 600.3212, the statute in such case made and provided and to pay said amount with interest as provided in said mortgage, and all legal costs, charges, and expenses, including attorney fees allowed by law.
At the date of this Notice there is claimed to be due for principal and interest on said mortgage the sum of SIXTEEN THOUSAND TWENTY THREE and 02/100($16,023.02) dollars. No suit or proceeding at law has been instituted to recover the debt secured by said mortgage or any part thereof.
Pursuant to Public Act No. 104, Public Acts of 1971 [MCLA 600.3240, MSA 27A.3240] the redemption period shall be 6 months from the date of the foreclosure sale, unless the property is determined to be abandoned under MCLA 600.3241a; MSA 27A.3241(1), in which case the property may be redeemed during the 30 days immediately following the sale or expiration of statutory notice period.
If the property is sold at foreclosure sale under Chapter 32 of the Revised Judicature Act of 1961, pursuant to MCl 600.3278 the borrower will be held responsible to the person who buys the property at the mortgage foreclosure sale or to the mortgage holder for damaging the property during the redemption period.
The premises covered by said mortgage are situated in the Township of Kalamo, County of Eaton, State of Michigan, described as follows, to wit:
That part of the South 120 rods of the West ½ of the Southeast 1/4 and the South 120 rods of the East ½ of the Southwest 1/4 lying East of the centerline of Lacey Lake Road, Section 13, T2N, R6W, Kalamo Township, Eaton County, Michigan, described as: Beginning on the centerline of Lacey Lake Road at a point which is 471.18 feet, N 89 degrees 25'26" W along the South line of Section 13 and 976.00 feet along the centerline of Lacey Lake Road from the South 1/4 corner of Section 13; thence N 00 degrees 18'35" E, 140.00 feet along said centerline; thence S 89 degrees 25'26" E, 1453.00 feet; thence N 00 degrees 18'35" E, 521.42 feet; thence N 88 degrees 58'44" E, 348.91 feet; thence S 00 degrees 13'47" W, 670.00 feet on the East line of the West ½ of the Southeast 1/4 of Section 13; thence S 88 degrees 58' 44" W, 1406.12 feet; thence N 00 degrees 18'35" E, 38.05 feet; thence N 89 degrees 25'26" W, 397.00 feet to the point of beginning. Together with and subject to a 66 foot wide drive easement, 33 feet each side of the centerline which is described as: Beginning on the centerline of Lacey Lake Road at a point 471.18 feet; N 89 degrees 25'26" W along the South line of Section 13 and 1116.00 feet N 00 degrees 18'35" E along the centerline of Lacey Lake Road from the South 1/4 corner of Section 13; thence S 89 degrees 25'26" E, 591 feet to the point of ending. The default and foreclosure proceedings include a 1996 Dutch Home mobile home, serial #19432Y, permanently affixed thereto, as evidenced by the Certificate of Mobile Home Title.
