In execution of the Deed of Trust in the original principal amount of $630,000.00 dated December 31, 2009 and recorded as Instrument No.100000704, of the County of Augusta land records, the appointed Substitute Trustee will offer for sale at public auction at the front steps of the Augusta County Circuit Court located at 1 E. Johnson Street, Staunton, VA 24402 on April 28, 2026 at 10:00 AM, the property described in said deed of trust, located at the above address and more particularly described as follows:

The following described property, to wit:
All those two certain tracts or parcels of land, with all improvements thereon and appurtenances thereto belonging, situate in Beverley Manor District, Augusta County, Virginia, a short, distance west of the corporation limits of the City of Staunton on the northwest side of Route 250, known as the Middlebrook Road, being a portion of the property known as Buck Hill. Tract 1 contains 9.572 acres and Tract 2 contains 0.465 acres, making this a conveyance of 10.037 acres, all of which is as described on a plat of survey by J.W. Harris, Certified Land Surveyor, dated May 3, 1982, a copy of which is attached to and made a part of this deed.
Tract 1 is a portion of the real estate conveyed to Joseph E. Furr and Anna T. Furr by Deed of Erskine M. Furr and Julia Catherine Furr, husband and wife, which deed is dated March 12, 1970, and is recorded in the Clerk's Office of the Circuit Court of Augusta County, Virginia, in Deed Book 557, at page 170. Tract 2 is a portion of the real estate conveyed to Joseph E. Furr by Deed of Gift from Erskine M. Furr and Julia Catherine Furr, husband and wife, which deed is dated December 23, 1975, and is of record in the Clerk's Office of the Circuit Court of Augusta County, Virginia, in Deed Book 649, at page 23, Tract 2 being a portion of the tract of land described as Tract 3 therein.
BEING KNOWN AS PARCEL NUMBER: 055-F-1-3.
Subject to all restrictions, rights of way, easements and other conditions contained in deed forming the chain of title to the caption property.

The property and improvements will be sold in “as is” physical condition without warranty of any kind.
TERMS OF SALE: A non-refundable bidder’s deposit of 10% of the sale price or 10% of the original principal amount of the subject Deed of Trust, whichever is lower, by cashier’s or certified check, required at time of sale except for the party secured by the Deed of Trust. Risk of loss on purchaser from date and time of auction. Balance of the purchase price must be paid by cashier’s check within 15 days from sale date. Except for Virginia Grantor’s tax, all settlement costs and expenses are purchaser’s responsibility. Taxes are pro-rated to the date of sale. Purchaser is responsible for obtaining possession of the property. If purchaser defaults, deposit may be forfeited and property resold at the risk and cost of the defaulting purchaser who shall be liable for any deficiency in the purchase price and all costs, expenses and attorney’s fees of both sales. If Trustee does not convey title for any reason, purchaser’s sole remedy is return of deposit without interest. This sale is subject to post-sale audit by the Substitute Trustee of the conduct of the auction itself as well as the status of the loan secured by the Deed of Trust, including, but not limited to, determining whether prior to sale a bankruptcy was filed, a forbearance, repayment or other agreement was entered into or the loan was reinstated or paid off; in any such event this sale shall be null and void and purchaser’s sole remedy shall be return of deposit without interest.
