Pursuant to a power of sale contained in a certain Deed to Secure Debt with Power of Sale, dated May 24, 2023, executed by Capital Constructs II, LLC, hereinafter referred to as "Grantor", with the singular including the plural, in favor of Construction Loan Services II, LLC, hereinafter "Lender", recorded in Deed Book 05496 Pages 0416-0443, on June 19, 2023, the deed records of the Clerk of the Superior Court of Athens-Clarke, Georgia as assigned to Builders Capital Finance II, LLC recorded in Deed Book 05801 Pages 0509-5012, on March 17, 2026, and as further assigned to Builders Capital Mortgage Trust 2023-1 recorded in Deed Book 05804 Pages 0483-0486, on March 26, 2026, having been given to secure a debt evidenced by a Promissory Note in the original principal amount of $731,631.99 with interest at the rate stated in said Promissory Note, and by virtue of a default in the payment of the debt secured by said Security Deed, the undersigned attorney-in-fact for the aforesaid Grantor (which attorney-in-fact is Builders Capital Mortgage Trust 2023-1, the present holder of said Security Deed and debt secured thereby) will sell before the door of the courthouse in Athens-Clarke County, Georgia, within the legal hours of sale, for cash, to the highest bidder on Tuesday, June 2, 2026, the property which, as of the time of the execution of said Deed to Secure Debt, was described as follows:
All that tract or parcel of land together with all improvements thereon, situate, lying and being in the City of Athens, 216th District, G.M., Clarke County, Georgia and being a portion of the Ed Bazzelle Subdivision and being more particularly described on a certain plat of survey of said subdivision prepared by O. E. Cross and L.O. Drew, Surveyors, dated November 24,1953 and recorded in Plat Book 1, Page 71 in the Office of the Clerk of the Superior Court of Clarke County, Georgia, and being more particularly described according to said plat of survey as follows:
Beginning at the Northeasterly corner of Block M of said subdivision, which beginning corner is also the Southwesterly corner of the intersection of Bazzelle Avenue and Walker Street and running thence North 85 degrees West along the Southerly side of Bazzelle Avenue 342.9 feet to an iron pipe on the Westerly boundary line of said subdivision; running thence in a Southerly direction along said boundary line 206.7 feet to the Southwesterly corner of said subdivision; running thence Easterly along the Southerly line of Block N of said subdivision 344.6 feet to Walker Street; running thence Northerly along the Westerly side of Walker Street 206.5 feet to the beginning iron pin corner;
The tract herein conveyed includes all of Block M and Block N of said subdivision together with the 30 foot wide strip of land separating the two blocks shown on the plat of survey as Julia Drive, an unopened street.
Said property is commonly known as 301 Julious Dr, Athens GA 30606 Said sale will be made subject to the following items which may affect the title to said property: All superior liens, restrictive covenants, easements and rights-of-way appearing of record, if any; all zoning ordinances; matters which would be disclosed by an accurate survey or by an inspection of the property; all outstanding and/or unpaid taxes which may be liens upon the property; and all outstanding or unpaid bills and assessments for street improvements, curbing, garbage, water, sewage and public utilities which may be liens upon said property.
