ORDINANCE NO. 5155
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CHANDLER, ARIZONA, APPROVING THE ABANDONMENT OF TEMPORARY DRAINAGE EASEMENT NO. 2 LOCATED ON THE ROCKEFELLER GROUP CHANDLER CROSSROADS PROPERTY AT THE NORTHEAST CORNER OF GILBERT AND QUEEN CREEK ROADS THAT IS NO LONGER NEEDED FOR PUBLIC USE.
WHEREAS, the Durango Kid, LLC, an Arizona limited liability company, has requested that the City of Chandler abandon Temporary Drainage Easement No. 2 (the “TDE”) located on the Rockefeller Group Chandler Crossroads property at the northeast corner of Gilbert and Queen Creek roads and has agreed to provide the required retention elsewhere on the property; and
WHEREAS, as a result of this relocation of the required retention, the existing retention basin is no longer needed for public use.
NOW, THEREFORE, BE RESOLVED that the City Council of the City of Chandler, Arizona, as follows:
Section 1. Authorizes the City of Chandler to abandon the TDE described in Exhibit “A” attached hereto.
Section 2. Approves the document used to abandon the TDE in the form approved by the City Attorney and attached hereto as Exhibit “B.”
Section 3. Authorizes the Mayor of the City of Chandler to execute and deliver all documents necessary to abandon the TDE.
