NOTICE OF COMPLAINT TO QUIET TITLE
SUMMONS – SERVICE BY PUBLICATION
1. This summons is to all defendants above named, to any other person who may be concerned, and each defendant whose whereabouts are currently unknown.
2. The above defendants are notified they have been sued in St. Joseph County Superior Court, 101 S Main St, South Bend, IN, 46601, phone 574-235-9893.
3. The action is entitled Estate of Eddie Lee Carpenter v Earline Carpenter, et al, cause no. 71D06-2604-PL-000067 by Plaintiff, Estate of Eddie Lee Carpenter, by Personal Representative Rose Carpenter, (“Plaintiff’). This summons by publication is specifically directed to defendant, Earline Carpenter, whose address and whereabouts are unknown.
In addition to the above named defendants being served by this summons, there may be other defendants who have an interest in this matter.
4. Plaintiff is represented by Kendra N. Key, 35953-49, Church Church Hittle + Antrim, 203 West Wayne Street, Suite 402, Fort Wayne, IN 46802; (260)399-9490; kkey@cchalaw.com.
5. The nature of this suit against the above defendants is a Complaint to Quiet Title. There may exist: (a) a defect in; (b) an apparent defect in; or (c) a cloud upon the title of real estate located east of 213 Camden St, South Bend IN, 46619, commonly known as parcel number 71-08-10-154-013.000-026 due to a defective or inaccurate record of owner of the real estate. Plaintiff does not currently claim damages against each defendant.
6. An answer or other response in writing to the complaint must be filed either by the defendants or their attorney within 30 days after the final notice of action is published, and if defendants fail to do so, judgment by default may be rendered against the defendants for the relief demanded in the com-plaint.
