Default having been made in the payments of debts and obligations to be paid under the loan secured by that certain Deed of Trust, Security Agreement, Assignment of Leases and Rents, Assignment of Contracts and Plans, and Fixture Filing, dated as of April 26, 2024, executed by E 3 Construction Services, LLC, a Tennessee limited liability company (“Debtor”), to Trustee Services Inc., as Trustee, and recorded in the Register’s Office of Davidson County, Tennessee, as Instrument No. 20240503-0032674, as amended by that certain Scrivner’s Affidavit and Notary’s Certificate of Correction, dated as of May 7, 2024 and recorded with the Davidson County Register’s Office as Instrument No. 20240508-0033874 (collectively, the “Deed of Trust”); and the undersigned, C. Joseph Hubbard, Robert T. Lowell and Keelin M. Kraemer, who may act severally, each having been appointed by Builders Capital Mortgage Trust 2023-2 (“Lender”), the holder of said indebtedness and obligations, as Substitute Trustees under the Deed of Trust, said appointment being recorded in the Davidson County Register’s Office as Instrument No. 20260414-0030253; and Lender having requested the undersigned to advertise and sell the property described in and conveyed to Lender in the Deed of Trust, all of said indebtedness and obligations having matured by default, this is to give notice that C. Joseph Hubbard, Robert T. Lowell and Keelin M. Kraemer, who may act severally, as Substitute Trustees, will on THURSDAY, MAY 21, 2026 AT 1:00 P.M. LOCAL TIME AT THE FRONT ENTRANCE OF THE DAVIDSON COUNTY COURTHOUSE, AT ONE PUBLIC SQUARE, NASHVILLE, TENNESSEE 37201, proceed to sell at public outcry to the highest and best bidder for cash the following described real and personal property (the “Property”) situated and being in Nashville, Davidson County, Tennessee, to wit:

Land in Davidson County, Tennessee, being Units 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 37, 38, 39, 40, 41, 42, 43, 44, 45 & 46, as shown on the Plan attached to the Declaration of Covenants, Conditions and Restrictions for Hidden Hills at North Pointe, a Horizontal Property Regime with Private Elements, of record in Instrument No. 20230713-0053779, in the Register's Office for Davidson County, Tennessee, to which Plan reference is hereby made for a more complete description of the property.
Being part of the same property conveyed to E 3 Construction Services, LLC, a Tennessee Limited Liability Company by Warranty deed from E3 Construction BD Capital, LLC, a Tennessee Limited Liability Company of record in Instrument No. 20220201-0011743 Register's Office for Davidson County, Tennessee, dated January 28, 2022 and recorded on February 1, 2022.
Being part of the same property conveyed to E3 Construction BD Capital LLC, a Tennessee limited liability company by Quitclaim Deed from E 3 Construction Services, LLC, of record in Instrument No. 220240228-0013631, in the Register’s Office for Davidson County, Tennessee.
All rights and equity of redemption, homestead, dower and all other exemptions are expressly waived by the Debtor in said Deed of Trust and title is believed to be good, but one of us will sell and convey only as Substitute Trustee. Title is to be conveyed subject to all liens with priority over the lien being foreclosed, and subject to easements, covenants, conditions, encumbrances and restrictions that may exist as of record and have priority over the lien being foreclosed, including, without limitation, any unpaid ad valorem taxes or other taxes, and also subject to any right to redemption that may otherwise exist for the benefit of the State of Tennessee or otherwise.
NOTICE OF SALE OF PERSONAL PROPERTY
UNDER TENNESSEE UNIFORM COMMERCIAL CODE
IN ADDITION TO THE SALE OF THE AFOREDESCRIBED REAL PROPERTY, C. Joseph Hubbard, Robert T. Lowell and Keelin M. Kraemer, who may act severally, as the duly authorized representatives of the Lender, shall sell all personal property described in the Deed of Trust concurrently and together with the foregoing real property, except that Substitute Trustees are not selling any reserves, escrows or deposit accounts held by Lender or that are in the possession of a third-party and subject to a control agreement for the benefit of Lender. The leases at the Property are intended to be sold as part of the personal property described as collateral described in the Deed of Trust, and none of the leases are intended to be extinguished or terminated due to foreclosure.
THIS SALE OF THE FOREGOING REAL AND PERSONAL PROPERTY WILL BE MADE WITHOUT ANY WARRANTY, EITHER EXPRESS OR IMPLIED, AS TO TITLE, CONDITION, MERCHANTABILITY OR FITNESS FOR ANY USE OR PURPOSE WHATSOEVER.
The undersigned, as the duly authorized representatives of the Lender, will convey only such title to the personal property as is vested in Lender under the Tennessee Uniform Commercial Code. Lender has no actual knowledge as to any specific items of personal property or the quantity, condition or sufficiency of the personal property to be conveyed hereunder.
Other interested parties: E 3 Construction Services, LLC; State of Tennessee; County of Davidson; City of Nashville; Metropolitan Government of Nashville and Davidson County – 413; Madkat Services, Inc.; Crosslin Building Supply, Inc.; Associated Masonry Products, Inc.; AMP Turnkey, LLC; Cherokee Building Materials, Inc. d/b/a Valley Interior Products, Inc.; American Express National Bank; Midway Supply Company, Inc.; J&J Services Inc.
Substitute Trustees reserve the right to (i) delay the sale to another time certain or adjourn the day of sale to another day and time certain, without further publication and in accordance with law, upon announcement of said delay or adjournment on the day and time and place of sale set forth above; (ii) sell the Property at the time fixed by the last postponement or to give new notice of sale; (iii) sell the Property in such lots, parcels, segments or separate estates as Substitute Trustees may choose; (iv) sell part of the Property and delay, adjourn, cancel or postpone the sale of the remaining part of the Property; (v) sell the Property in whole and then to sell the Property in parts and to consummate the sale in whichever manner produces the highest sale price; (vi) sell to the next highest bidder in the event any higher bidder does not comply with the terms of the sale.
This sale is subject to all matters shown on any applicable recorded Plat or Plan and any restrictive covenants, easements or setback lines that may be applicable. This sale is also subject to all matters that take priority over the Deed of Trust upon which this foreclosure sale is conducted or are not extinguished by this foreclosure sale including, but not limited to, any unpaid taxes and assessments (plus penalties, interest and costs) which exist as a lien against said Property; any rights of redemption, equity, statutory or otherwise, not otherwise waived in the Deed of Trust, including any rights of redemption of any governmental agency, state or federal; and any and all prior deeds of trust, liens, dues, assessments, encumbrances, defects, adverse claims and other matters. This sale is also subject to any matters that an inspection, environmental assessment or accurate survey of the Property might disclose.
