Henderson and/or his Heirs, Devisees and Legal Representatives, (2) Jared MacKenzie, (3) Jillian Hamilton, (4) Jamie MacIntosh, (5) Andrea (Martin) Elliott-Fry and/or her Heirs, Devisees and Legal Representatives, (6) Susan Rathburn and/or her Heirs, Devisees and Legal Representatives, (7) Carl Olsen and/or his Heirs, Devisees and Legal Representatives, (8) the Trustees and Successor Trustee(s) and Beneficiaries of the Mercantile Realty Co., (9) all other unknown persons claiming any interest in Old County Road as depicted in Plan Book 495, Page 50, their heirs, devisees or legal representatives, (10) the Heirs, Devisees and Legal Representatives of the following deceased individuals: Myrtie F. Charlton, Mary (Silliman) Charlton, Paul S. Charlton, Robert Henry Charlton, Ruth A. Charlton, Ethel Julia Charlton, Norman Archibald Charlton, Asa L. Pattee, Blanche H. Pattee, Eleanor H. Warren, Howard W. Taylor, Jean Alice (Currie) Taylor, Ainslee L. Taylor a/k/a Ainsley L. Chevalier, and David Chevalier, (11) Bruce Chevalier, and (12) Terre Tulsiak.
You are hereby notified that a civil action has been filed by the above-named plaintiff in which you are named as a defendant, wherein they are seeking alternative service of process by publication. Plaintiff filed the complaint seeking to remove clouds on title to property located in Falmouth, Massachusetts. Plaintiff seeks to reform a number of deeds in the chain of title to reflect the correct grantor (as an individual, not as trustee), seeks a declaration that Plaintiff has acquired title to a number of lots by adverse possession, and generally seeks an order declaring that Plaintiff currently holds 100% ownership interest in, and clear and marketable title of record to various tracts of land. The affected property is shown on the Plan recorded in Book 495, Page 50 and includes Parcel A, Parcel B, Parcel C, Lot 15, the Anthony Platani Parcel, the Howard Taylor Parcel, the Harry B. Crawford Parcel, and Old County Road as depicted on said plan.
This complaint may be examined at the Barnstable County Superior Court, or a copy obtained from plaintiff's attorney.
If you are a person claiming an interest in the above parcels and road, and you object to an Order declaring that CLSV Associates Limited Partnership is the rightful holder of title to said parcels, or if you intend to make any defense, you or your attorney must serve upon the plaintiff's attorney, Shannon F. Slaughter, Esq., Dalton & Finegold, LLP, whose address is 34 Essex Street, Andover, MA 01810 an answer to the complaint on or before the 11th day of June, 2026, next, the return day, hereof, and a copy thereof must be filed in this court on or before said day.
If you fail to do so, judgment by default will be taken against you for relief demanded in the complaint. Unless otherwise provided by Rule 13(a), your answer must state as a counterclaim any claim which you may have against the plaintiff which arise out of the transaction or occurrence that is the subject matter of the plaintiffs' claim, or you will thereafter be barred from making such claim in any other action.
It appearing to this Court that no personal service of the Complaint has been made on the defendants identified herein above that after diligent search Plaintiffs can find no such persons upon whom they can lawfully make service, it is ORDERED that notice of this suit be given to them by publishing a copy of this notice once in the Cape Cod Times, a newspaper general circulation in Falmouth in the County of Barnstable and said Commonwealth at least 20 days before the above responsive pleading due date.
