NOTICE OF FINAL DETERMINATION

Application for State Discharge Permit, 24DP0788, NPDES Permit MD0021776:
City of Hagerstown, Department of Utilities applied for renewal of the permit to discharge an average of 8.00 million gallons per day (MGD) of treated wastewater from the Hagerstown WWTP located at 1 Clean Water Circle, Hagerstown, MD 21740 to the Antietam Creek, designated as Use IV-P water, which is protected for holding or supporting adult trout for put-and-take fishing, and as a public water supply.
On December 10 and 17, 2025, the Maryland Department of the Environment (MDE) published notices of its tentative determinations (TDs) to reissue the discharge permit. Following publication of the TD notice, MDE received a request for a public hearing from the Potomac Riverkeeper Network, which was held on March 25, 2026. During the public hearing and the comment period that ended on March 30, 2026, MDE received joint comments from the Potomac Riverkeeper Network (PRKN) and the Chesapeake Legal Alliance (CLA).
MDE has prepared a Comment Response Document (CRD) to address these comments and made a final determination to reissue the discharge permit as proposed in the tentative determination.
Per MD Environmental Article § 1–602(a)(2), an EJ score was calculated for this facility. The EJ Score is 82.4. This score has been calculated considering a combination of the following factors: Pollution Burden Exposure Percentile, Pollution Burden Environmental Effects Percentile, and Sensitive Population Percentile. Any person adversely affected by this final determination may petition for judicial review. Petitions for judicial review of a final determination or permit decision subject to judicial review must be filed per § 1-605 of the Environment Article no later than 30 days following publication by the Department of this notice of final determination. They must be submitted to the county's circuit court, which is specified in the permit application as the location where the proposed activity will occur. Petitions for judicial review must comply with the applicable Maryland Rules of Civil Procedure. Failure to file a petition for judicial review by June 12, 2026 will constitute a waiver of any right to a judicial review of this final determination.
