NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by James F. Mitchell, Barbara J. Mitchell to Boston Five Cents Savings Bank, FSB, dated June 28, 1989 and recorded in the Norfolk County Registry of Deeds in Book 8357, Page 609, as modified by a certain modification agreement recorded on February 5, 2024, and recorded with said Norfolk County Registry of Deeds in Book 41628, Page 220, of which mortgage the undersigned is the present holder, by assignment from:
Citizens Bank of Massachusetts to Dovenmuehle Mortgage Company L.P., recorded on October 22, 1997, in Book No. 12045, at Page 450 Dovenmuehle Mortgage Company L.P. to Mortgage Electronic Registration Systems, Inc., recorded on July 6, 2004, in Book No. 21264, at Page 420 Mortgage Electronic Registration Systems, Inc. to EverHome Mortgage Company, recorded on April 23, 2010, in Book No. 27616, at Page 361 EverBank to Green Tree Servicing LLC, recorded on January 30, 2015, in Book No. 32872, at Page 175 Ditech Financial LLC f/k/a Green Tree Servicing LLC to New Penn Financial, LLC d/b/a Shellpoint Mortgage Servicing, recorded on August 14, 2017, in Book No. 35357, at Page 302 Citizens Bank NA s/b/m RBS Citizens NA s/b/m Boston Five Cents Savings Bank, FSB to EverBank, recorded on April 13, 2022, in Book No. 40460, at Page 518 for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at Public Auction at 2:00 PM on June 3, 2026, on the mortgaged premises located at 371 Coronation Drive, Franklin, Norfolk County, Massachusetts, all and singular the premises described in said mortgage,
TO WIT:
The land together with the buildings thereon, being shown as Lot 17 on "Plan of Land in Franklin, Mass. Scale 1"=50'. May 17, 1984" prepared by William J. Rossetti, Reg. Land Surveyor, said Plan being recorded with Norfolk County Registry of Deeds in Book 6405, Page 558, as Plan No 603 of 1984. said premises being bounded and described according to said plan as follows:
NORTHERLY by Beverly Road, 95.00 feet;
EASTERLY by land unidentified on said plan, 169.91 feet;
SOUTHWESTERLY by Parcel C, 125.89 feet;
WESTERLY by Coronation Drive, 125.00 feet;
NORTHWESTERLY by a curved line forming the junction of Coronation Drive and Beverly Road, 47.12 feet.
Said premises consist of approximately 20,113 square feet of land according to said plan.
For mortgagor's(s') title see deed recorded with Norfolk County Registry of Deeds in Book 8357, Page 608.
These premises will be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
TERMS OF SALE:
A deposit of Fifteen Thousand ($15,000.00) Dollars by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check at Harmon Law Offices, P.C., 150 California St., Newton, Massachusetts 02458, or by mail to P.O. Box 610389, Newton Highlands, Massachusetts 02461-0389, within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price.
