ORDINANCE [To Extend the Temporary Moratorium on Permits and Approvals for Package Stores, Convenience Stores, Gas Stations, and Vape Shops in the Corporate Limits of Prattville.] WHEREAS, in Ordinance Book 2025, Page 013, on May 6, 2025, the City Council of the City of Prattville declared a temporary moratorium on permits and approvals for Package Stores, Convenience Stores, Gas Stations, and Vape Shops in the Corporate Limits of Prattville while the zoning ordinance was reviewed and adjusted; and WHEREAS, in Ordinance Book 2026, Page 002, on January 20, 2026, the City Council amended the temporary moratorium to include that the transfer of existing licenses resulting in the sale of existing establishments currently licensed as described herein would be exempt from the terms of the Ordinance; and WHEREAS, due to unforeseen circumstances, a comprehensive review of the zoning ordinance has not been completed at this time; and WHEREAS, the City is in the process of hiring a Planning and Development Director to further review the zoning ordinance and address the issue of Package Stores, Convenience Stores, Gas Stations, and Vape Shops; and WHEREAS, the City Council desires to extend the temporary moratorium on the issuance of permits and approvals for Package Stores, Convenience Stores, Gas Stations, and Vape Shops until the zoning ordinance can be reviewed and adjusted. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Prattville that in order to protect the public health, safety, and welfare of its residents, it is in the best interest of the City to extend the temporary moratorium on the issuance of permits or other approvals for any Package Stores, Convenience Stores, Gas Stations, and Vape Shops, in order for the City to complete its review of the zoning ordinance as to these entities. BE IT FURTHER ORDAINED that the extension of the temporary moratorium shall be effective upon passage and publication, and shall continue through May 18, 2027, unless terminated or extended by action of the City Council. THE provisions of this Ordinance are severable. If any portion of this Ordinance is declared invalid or unconstitutional, such declaration shall not affect the parts which remain.
