Premises Address: 86 Parkside Drive, Suffern, NY 10901 (referred to as the “Premises”)
Shares of Stock: 43 for the Premises, (referred to hereinafter as “Shares Premises”) in Apartment Corporation
Amount Due: $22,089.90, for maintenance, assessments, and other charges due for the Premises to the Cooperative as of May 1, 2026, (referred to herein as “Sums Due Premises”)
Sale: The Foreclosure Sale specifically includes the sale of the Premises designated as Apartment 86, with Total Arrears of $22,089.90 as of 05/01/2026.

BY VIRTUE OF DEFAULT, by the above-named Shareholder under the Proprietary Lease for both the above-referenced Premises and Space, located at 86 Parkside Drive, Unit/Apt. 86, Suffern, NY 10901 in the County of Rockland, in conjunction with the termination of the aforesaid Proprietary Lease and the subsequent cancellation of the Shares of common stock of the Cooperative appurtenant to and allocated to the Premises.
NOTICE IF HEREBY GIVEN that the Cooperative, as the holder of the first lien of the collateral hereinafter described as the Premises, will sell the aforesaid Collateral at a Public Auction on the aforesaid Sale Date and Time, subject to the conditions set forth in the Terms of Sale, which include the sale of both the Premises. Please note the Terms of Sale will be distributed and read at the Sale and which will be available, upon request, and is subject to such revisions thereto, which may be announced at the start of the Public Auction.
SAID PUBLIC AUCTION will be held on June 1, 2026, and commence at 2:00PM to be held at the Rockland County Court House, located at 1 South Main Street, New City NY 10956, at which time the respective Shares of capital stock of the Cooperative attributable to both the Premises and Space, with the Proprietary Lease appurtenant thereto, will be sold together based upon the Terms of Sale.
THE COLLATERAL consists of the Shares of capital stock in the Cooperative attributable to the Premises and Space, together with all right, title and interest to the appurtenant Proprietary Lease.
THE COLLATERAL will be sold "as is" without representation or warranty and is subject to, among other things, any rent stabilized and rent controlled tenant's right to use and/or the current occupancy of the Premises, pursuant to all applicable laws and regulations and is sold SUBJECT to the Terms of the Sale to be read at the auction.
THE COOPERATIVE reserves the right to reject any and all bids to the extent that the amount bid for the Premises does not cover the amount of past due Arrears for the Premises, plus interest, late fees, costs, expenses and fees, auctioneer and other administrative fees, reasonable attorney fees, and other charges due and owing and/or allocable to the Premises as result of the default of the above-named Shareholder.
THE COOPERATIVE reserves the right to bid, to become the Purchaser at the sale and, without deposit, credit against the purchase price bid all sums due to it under the Lease and/or to adjourn, delay or terminate the sale.
THE SUCCESSFUL BIDDER shall be required to submit the standard purchase application to the Management Agent and obtain the consent of the Cooperative and occupy the Premises as his/her primary residences. Accordingly, this sale is subject to the approval of the Board of Directors of the Cooperative and the Successful Bidder must deposit 10% of the successful bid price or the Sums Due plus accrued maintenance, assessments, attorney's fees and costs, whichever is greater, in escrow with the attorney for Cooperative. All CHECKS MUST BE MADE PAYABLE TO HIMMELFARB & SHER, LLP, AS ESCROW AGENT. (ENDORSED CHECKS -CASH WILL NOT BE ACCEPTED)
