NOTICE OF FINAL DETERMINATION
Washington County
Application for State Discharge Permit 21DP2563, NPDES Permit MD0063509:
The Washington County Water Quality Department has applied for a permit renewal to discharge treated wastewater at an average rate of 4.50 million gallons per day (mgd) from the Conococheague Wastewater Treatment Plant (WWTP), located at 16232 Elliott Parkway, Williamsport, MD 21795 to Conococheague Creek, which is designated as Use IV-P waters, protected for holding or supporting adult trout for put-and-take fishing, and as a public water supply.
Final Determination
Written comments were received from the Potomac River Keeper Network (PRKN) regarding the notice of tentative determination published in The Herald-Mail newspaper on the 17th and 24th of October 2025. After a thorough review of the comments, the Department has decided to reissue the permit as proposed in the tentative determination.
Per MD Environmental Article § 1–602(a)(2), an EJ score of 69.4 was calculated for this facility. This score has been calculated based on a combination of the following factors: Pollution Burden Exposure Percentile, Pollution Burden Environmental Effects Percentile, and Sensitive Population Percentile. Any person adversely affected by this final determination may file a petition for judicial review. Petitions for judicial review of a final determination or permit decision subject to judicial review must be filed in accordance with § 1-605 of the Environment Article, no later than 30 days following publication by the Department of this notice of final determination, and must be filed in the circuit court of the county where the permit application states that the proposed activity will occur. Petitions for judicial review must conform to the applicable Maryland Rules of Civil Procedure. Failure to file a petition for judicial review by June 15, 2026, will constitute a waiver of any right to a judicial review of this final determination.
