SUBSTITUTE TRUSTEE'S NOTICE OF SALE
WHEREAS, on the June 2, 2017, Robert H Pell and Ashley R Pell, executed a Deed of Trust to Olen C Bryant, Jr., Trustee for the use and benefit of Mortgage Electronic Registration Systems, Inc., as beneficiary, as nominee for Liberty Bank and Trust Co. A/K/A Liberty Bank and Trust Company, its successors and assigns, which Deed of Trust is on file and of record in the office of the Chancery Clerk of Hinds (2nd District - Raymond) County, Mississippi, in Deed of Trust June 5, 2017, in Book No. 638, at Page 8217 thereof;
WHEREAS, said Deed of Trust was ultimately assigned to Planet Home Lending, LLC by assignment on file and of record in the office of the Chancery Clerk of Hinds (2nd District - Raymond) County, Mississippi, in March 20, 2023, in Book No. 646, at Page 6098 thereof; and
WHEREAS, the legal holder of the said Deed of Trust and the note secured thereby, substituted Foundation Legal Group, LLP fka Wilson & Associates, PLLC, as Trustee therein, as authorized by the terms thereof, by instrument recorded in the office of the aforesaid Chancery Clerk in January 16, 2026, in Book No. 649, at Page 6486 thereof; and
WHEREAS, default having been made in the performance of the conditions and stipulations as set forth by said Deed of Trust, and having been requested by the legal holder of the indebtedness secured and described by said Deed of Trust so to do, notice is hereby given that Foundation Legal Group, LLP fka Wilson & Associates, PLLC, Substitute Trustee, by virtue of the authority conferred upon me in said Deed of Trust, will offer for sale and will sell at public sale and outcry to the highest and best bidder for certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee, during the legal hours (between the hours of 11 o'clock a.m. and 4 o'clock p.m.) Hinds County Courthouse (2nd Judicial District), 127 West Main Street, Raymond, MS 39154, on May 29, 2026, the following described land and property being the same land and property described in said Deed of Trust, situated in Hinds (2nd District - Raymond) County, State of Mississippi, to-wit:
All that part of the E1/2 of the SW1/4 of Section 9, Township 13 North, Range 5 East, Second Judicial District of Hinds County, Mississippi, that lies north of the Utica and Hall's Ferry public road (presently known as the Fisher's Ferry Road), and west of the old road bed of the old public road leading from the Utica and Hall's Ferry public gravel road north towards Cayuga, and being part of the same land conveyed to L. L. Knight and wife, Mrs. Eva Knight by Mrs. Eugenia Brent as shown by deed duly recorded in the office of Chancery Clerk of Hinds County at Raymond, Mississippi, and the same land conveyed to E. C, Knight by L. L. Knight and wife, Mrs. Eva Knight, as shown by deed duly recorded in the office of the Chancery Clerk of Hinds County at Raymond, Mississippi, in Deed Book 130, Page 549, thereof, reference to which is hereby made. Less and Except; 1.97 acres, more or less, situated in the NE1/4 of the SW1/4 of Section 9, Township 13 North, Range 5 East, Hinds County, Mississippi, more particularly described as follows, to-wit: Commence at a right-of-way marker on the north side of Duke Road (Project No. FAS RS04C3(6) B) marking the P.T. Station 30+85 53 according to the construction plans of said Duke Road (Project No. FAS RS04C3(6) B), reference to which is hereby made in aid of and as a part of this description, run thence south 68 degrees 06 minutes 00 seconds east and along said north right-of-way line of Duke Road for a distance of 220.21 feet to an iron pin marking the point of beginning for this description of a parcel of land described as follows: Continue thence south 68 degrees 06 minutes 00 seconds east for a distance of 190.73 feet to an iron pin, run thence leaving said north right-of-way line of Duke Road, north 14 degrees 49 minutes 37 seconds east for a distance of 236.77 feet to a point in a fence line, run thence north 12 degrees 30 minutes 32 seconds east and along said fence line for a distance of 168.07 feet to a point, run thence north 03 degrees 44 minutes 34 seconds east for a distance of 80.31 feet to an iron pipe, said iron pipe being north 78 degrees 53 minutes 23 seconds west a distance of 287.64 feet from an iron bar marking the apparent southeast corner of the NW1/4 of Section 9, Township 13 North, Range 5 East, Hinds County, Mississippi, run thence north 76 degrees 18 minutes 20 seconds west for a distance of 160.00 feet to an iron pin, run thence south 15 degrees 42 minutes 51 seconds west for a distance of 456.92 feet to the point of beginning. Less and Except the land recorded in Book 725, Page 613.
Title to the above described property is believed to be good, but I will convey only such title as is vested in the aforementioned Substitute Trustee.
