NOTICE OF TENTATIVE DETERMINATION

Application for State Discharge Permit 23DP0593, NPDES Permit MD0020532:
The Town of Delmar, 100 South Pennsylvania Avenue Delmar, Maryland 21875 applied for renewal of the permit to discharge an average of 0.85 million Gallons per Day (MGD) of treated domestic wastewater from the Delmar Wastewater Treatment Plant located at 30055 Connelly Mill Road Delmar, Wicomico County, Maryland 21875 to Wood Creek flows into the Leonard Pond Run., which is a Use I is designated as water protected for water contact recreation and non-tidal warm water aquatic life.
The Maryland Department of the Environment (MDE) is proposing to reissue the permit with the following effluent limitations: BOD5, 20 mg/l maximum monthly arithmetic mean, 30 mg/l maximum weekly arithmetic mean during the summer months; 30 mg/l maximum monthly arithmetic mean, 45 mg/l maximum weekly arithmetic mean during the winter months; Total Suspended Solids, 21 mg/l maximum monthly arithmetic mean, 31 mg/l maximum weekly arithmetic mean; Total Ammonia 1.5 mg/l maximum monthly arithmetic mean, 10.5 mg/l maximum daily in the summer months & 3.0 mg/l maximum monthly arithmetic mean, 12.5 mg/l maximum daily in the winter months as interim limits; Total Ammonia 1.0 mg/l maximum monthly arithmetic mean, 7.0 mg/l maximum daily in the summer months & 1.5 mg/l maximum monthly arithmetic mean, 8.0 mg/l maximum daily in the winter months as final limits; Dissolved Oxygen, 5.0 mg/l minimum at any time; E. coli, 126 MPN/100 ml monthly geometric mean value concentration and pH maintained between 6.5 and 8.5. Total ammonia nitrogen - N (Final limits) will be effective as soon as possible, but no later than twelve (12) months after the effective date of the discharge permit.
All effluent limitations meet the State water quality standards and comply with the local TMDLs for Phosphorous and Sediments to Johnson Pond in the Upper Wicomico Watershed in Wicomico and TMDL of Fecal Bacteria for the non-tidal Wicomico River Headwaters Basin in Wicomico County, Maryland. This facility is a part of the Chesapeake Bay watershed. The effluent limits are established to ensure compliance with State water quality standards. The minimum monitoring and reporting requirements for effluent and raw wastewater influent are mandated to ensure compliance with the permit requirements.

If a written request is received by June 3, 2026, a public hearing on the tentative determination for this application can be scheduled. The request should be sent to the Maryland Department of the Environment, Water and Science Administration, 1800 Washington Blvd., Baltimore, Maryland 21230-1708, Attn.: Yen-Der Cheng, Chief, Municipal Permits Division and must include the name, address and telephone number (home and work) of the person making the request, the name of any other party whom the person making the request may represent, and the name of the facility and permit number. Failure to request a hearing by June 3, 2026 will constitute a waiver of the right to a public hearing on the tentative determination for this permit.
Written comments concerning the tentative determination will be considered in the preparation of a final determination if submitted to the Department, to the attention of Yen-Der Cheng at the above address, on or before June 15, 2026.
