By virtue and in execution of the Power of Sale contained in a certain Mortgage given by Scott Marceau and Christine Marceau to Mortgage Electronic Registration Systems, Inc., as nominee for Envision Bank, its successors and assigns, dated February 25, 2021 and recorded with the Bristol County (Fall River District) Registry of Deeds at Book 10464, Page 147, subsequently assigned to PNC Bank, National Association by Mortgage Electronic Registration Systems, Inc., as Mortgagee, as nominee for Envision Bank, its Successors and assigns by assignment recorded in said Bristol County (Fall River District) Registry of Deeds at Book 11703, Page 264 for breach of the conditions of said Mortgage and for the purpose of foreclosing same will be sold at Public Auction at 11:00 AM on June 3, 2026 at 70 Evergreen Avenue, Somerset, MA, all and singular the premises described in said Mortgage, to wit:
The land in Somerset, Bristol County, Massachusetts, with all the buildings and improvements thereon, bounded and described as follows:
Beginning at a point on the northerly line of Evergreen Avenue at the southwesterly corner of land to be described and at the southeasterly corner of Lot #25 on Plan of Land hereinafter referred to; thence running easterly in the said northerly line of Evergreen Avenue eighty four and 47/100 (84.47) feet to a granite bound and the tangent point of a curve; thence running easterly, northeasterly and northerly fifty five and 26/100 (55.26) feet to another tangent point of a curve and a granite bound set in the westerly line of Altas Avenue for a corner; thence running northerly in the said westerly line of Atlas Avenue, forty nine and 64/100 (49.64) feet to the southeasterly corer of Lot #27 on said Plan; thence running in a westerly direction in part by said Lot #27 and in part by Lot #24 on said Plan, one hundred thirty two (132) feet to the northeasterly corner of Lot #25 for a corner; thence running in a southerly direction by said Lot #25, eighty (80) feet to the northerly line of Evergreen Avenue and the point of beginning; containing 9,904 square feet of land, more or less. Being Lot #26 on Subdivision Plan of Land in Somerset, Mass. Belonging to "Ridgeview of Tiverton, Inc." Surveyed by Manuel R. Salgado, Jr. Civil Engineer, 222 Elm Street, Somerset, Mass., Scale 1" = 50' Date: May 5, 1960, on file in the Fall River District Registry of Deeds.
Subject to restrictions set forth in Deed from Ridgeview of Tiverton, Inc., to David Kaufman dated December 20, 1962 recorded with said Registry in book 792, Page 22-23-24-25.
Being the same premises conveyed to the Mortgagor(s) herein by deed recorded with said Registry in Book 8253, Page 47.
The premises are to be sold subject to and with the benefit of all easements, restrictions, encroachments, building and zoning laws, liens, unpaid taxes, tax titles, water bills, municipal liens and assessments, rights of tenants and parties in possession, and attorney’s fees and costs.
TERMS OF SALE:
A deposit of TEN THOUSAND DOLLARS AND 00 CENTS ($10,000.00) in the form of a certified check, bank treasurer’s check or money order will be required to be delivered at or before the time the bid is offered. The successful bidder will be required to execute a Foreclosure Sale Agreement immediately after the close of the bidding. The balance of the purchase price shall be paid within thirty (30) days from the sale date in the form of a certified check, bank treasurer’s check or other check satisfactory to Mortgagee’s attorney. The Mortgagee reserves the right to bid at the sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney. The description of the premises contained in said mortgage shall control in the event of an error in this publication. TIME WILL BE OF THE ESSENCE.
