By virtue and in execution of the Power of Sale contained in a certain mortgage given by Daniel R. Sweeney and Nancylee R. Sweeney to Bank of America, N.A., and now held by NewRez LLC d/b/a Shellpoint Mortgage Servicing, said mortgage dated August 19, 2005 and recorded in the Worcester County (Worcester District) Registry of Deeds in Book 37148, Page 263, said mortgage was assigned from Bank of America, N.A. to Green Tree Servicing LLC by assignment dated April 29, 2013 and recorded with said Registry of Deeds in Book 51021, Page 75; said mortgage was assigned from Ditech Financial LLC F/K/A Green Tree Servicing LLC to New Residential Mortgage LLC by assignment dated February 14, 2020 and re-corded with said Registry of Deeds in Book 61902, Page 223; said mortgage was assigned from New Residential Mortgage, LLC to New-Rez LLC d/b/a Shellpoint Mortgage Servicing by as-signment dated November 19, 2025 and recorded with said Registry of Deeds in Book 72880, Page 109; for breach of the conditions in said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on June 11, 2026 at 03:00 PM Local Time upon the premises, all and singular the premises described in said mortgage, to wit:
A certain parcel of land situated on the westerly side of Pine Street, in said Gardner, Worcester County, Massachusetts, bounded and de-scribed as follows, to wit --
Beginning at the northeasterly corner thereof at a point in the westerly line of Pine Street at land now or formerly of Lena R. Piper;
Thence southerly at an included angle of 90° 00' by the westerly line of Pine Street 44.17 feet to a corner at land now or formerly of Isak S. Johnson;
Thence westerly at an in-cluded angle of 89º 10' by land of said Johnson 99.77 feet to a corner in line of land of L. and G. Corporation;
Thence northerly at an in-cluded angle of 92º 00' by land of L. and G. Corporation 42.72 feet to a corner at a corner of land now or formerly of Lena R. Piper;
Thence easterly at an included angle of 88° 50' by land of said Piper 100.65 feet to the westerly line of Pine Street and the place of beginning.
The above described pre-mises are conveyed subject to a right of way five (5) feet in width adjoining the southerly boundary and ex-tending its entire length.
Also conveying a right of way five (5) feet in width over the premises adjoining the conveyed premises on the south, thus forming a right of way ten (10) feet in width to be used in common with the abutters on the south for the entire length of said boundary line.
Being the same premises shown on a plan of land entitled "Compiled Plan of Land of Morton C. Woodbury et ux, Gardner, Mass ., Scale: 1 inch = 20 ft ., September 12, 1980, Mi-chael S. Szoc, Surveyor" re-corded with Worcester District Registry of Deeds in Plan Book 479, Plan 57.
Being the same premises conveyed to the mortgagors by Quitclaim Deed from Steven C. Lowe and Leonard DeSantis, Trustees dated September 17, 1987 re-corded in the Worcester Southern District Registry of Deeds in Book 10803, Page 215.
The description of the property contained in the mortgage shall control in the event of a typographical error in this publication.

TERMS OF SALE: Said pre-mises will be sold and con-veyed subject to all liens, encumbrances, unpaid tax-es, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described.
FIVE THOUSAND ($5,000.00) Dollars of the purchase price must be paid in cash, certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid in cash, certified check, bank treasurer's or cashier's check within thirty (30) days after the date of sale.
