ORIGINAL NOTICE (Publication) TO THE ABOVE-NAMED DEFENDANT: You are notified that on the 30th day of March, 2026, a Citation was filed in the Office of the Clerk of Court for Polk County, Iowa naming you as Defendants in the above-captioned action. The Citation prays that the property legally described as: Lot 29 DEWEY HEIGHTS, and locally known as 1509 Guthrie Avenue, Des Moines, Iowa, is in violation with the Municipal Code of the City of Des Moines, Section 134-2.2.5.I, 134-3.1-1, 134-3.9 and 134-3.9.6.E by allowing property to be used as a salvage yard and/or junk yard and/or equipment and material storage outdoors; by allowing inoperable unsafe, and/or unlicensed vehicles, vehicular component parts and/or miscellaneous junk and debris to be stored outside. Further, Plaintiff prays: The Court order the Defendant to cease all business activity and prohibited uses; permanently remove from property and right-of-way or store inside a completely enclosed building, the associated vehicles, material and equipment; remove from property and right-of-way or store inside the inoperable, unsafe and unlicensed vehicles, vehicular component parts and miscellaneous junk and debris; and schedule an inspection upon completion of all listed remedial action. Further, the Plaintiff requests that if the property is not abated in the time ordered by the court, the Plaintiff be authorized to enter upon the property and fenced area (if applicable) and abate the violations. Further, the Plaintiff requests that the court assess in rem against the property for the costs of this action and the costs incurred in the enforcement of the Municipal Code of the City of Des Moines, Iowa, inclusive of all fines and civil penalties incurred, all with interest.
