By virtue and in execution of the Power of Sale contained in a certain Mortgage dated December 21, 2012, from Theodore M. Anderson and Karen Anderson to Mortgage Electronic Registration Systems, Inc., as nominee for Merrimack Mortgage Company, Inc., recorded with the Norfolk County Registry of Deeds in Book 30855, Page 420, as affected by Modification Agreement recorded March 3, 2017 in Book 34953, Page 306, the undersigned U.S. Bank Trust National Association, not in its individual capacity, but solely as trustee of the Truman 2021 SC9 Title Trust being the present holder of said mortgage by Assignment of Mortgage dated November 13, 2017 from Mortgage Electronic Registration Systems, Inc., as nominee for Merrimack Mortgage Company, Inc., its successors and assigns, to Nationstar Mortgage LLC d/b/a Mr. Cooper recorded in Book 35632, Page 469, Assignment of Mortgage dated December 27, 2017 from Mortgage Electronic Registration Systems, Inc., as nominee for Merrimack Mortgage Company, Inc., its successors and assigns, to Wells Fargo Bank, N.A. recorded in Book 35704, Page 60, Assignment of Mortgage dated December 29, 2017 from Nationstar Mortgage LLC to Wells Fargo Bank, N.A. recorded in Book 35713, Page 561, Assignment of Mortgage dated August 2, 2019 from Wells Fargo Bank, N.A. to Specialized Loan Servicing LLC recorded in Book 37054, Page 7, and Assignment of Mortgage dated May 27, 2022 from Specialized Loan Servicing LLC to U.S. Bank Trust National Association, not in its individual capacity, but solely as trustee of the Truman 2021 SC9 Title Trust recorded in Book 40613, Page 361, for breach of the conditions of said Mortgage and for the purpose of foreclosing the same will be sold at Public Auction at:

upon the hereinafter-described premises, known as and numbered as 43 Chisholm Road, Weymouth, Norfolk County, Massachusetts, all and singularly the premises described in said mortgage, to wit:
A certain parcel of land with the buildings thereon, situated in Weymouth, Norfolk County, Massachusetts, known as and numbered 43 Chisholm Road, Weymouth, Massachusetts, being shown as Lot 25 on a plan entitled “Hunters’ Hill’, Plan of Subdivision of Land in (South) Weymouth, Mass. for Daniel A. Brown, Jr., dated November 14, 1951, Russell H. Whiting, C.E. and recorded with Norfolk Deeds Plan Book 167, Plan 1428, bounded and described on said plan as follows:
NORTHEASTERLY by Chisholm Road, seventy-five (75) feet;
SOUTHEASTERLY by Lot 24, two hundred eleven (211) feet, more or less;
SOUTHWESTERLY by Old Swamp River, eighty-two (82) feet, more or less; and
NORTHWESTERLY by Lot 26, one hundred ninety (190) feet, more or less.
Containing 15,600 square feet of land, more or less, according to said plan.
Being all and the same premises conveyed to Theodore M. Anderson and Karen Anderson by deed of Susan Waugh and David DiLillo, Trustees of the DiLillo Family Realty Trust, dated June 23, 2011 and recoded with the Norfolk County Registry of Deeds on June 27, 2011 in Book 28903, Page 7.
The above-described premises shall be subject to all easements, restrictions, municipal or other public taxes, assessments, liens or claims in the nature of liens, outstanding tax titles, building, zoning and other land use laws and all permits and approvals issued pursuant thereto, including, without limitation, orders of conditions, and existing encumbrances of record created prior to said Mortgage, if there be any. Said premises are to be sold subject to the right of redemption of the United States of America, if any there be.
TERMS OF SALE: The highest bidder shall be required to make a deposit of $10,000.00 to the holder of said Mortgage, in cash or by certified or bank cashier's check at the time and place of said sale of said premises. The balance of the purchase price is to be paid to said holder in cash, by certified check or bank cashier's check, and thereupon the deed shall be delivered, in thirty (30) days from the date of sale at the firm of Cunningham, Machanic, Cetlin, Johnson, Harney & Tenney, LLP, Attorneys for said holder, 220 North Main Street, Suite 301, Natick, Massachusetts. The successful bidder shall be required to sign a Memorandum of Terms of Sale. The description of the premises contained in said Mortgage shall control in the event of an error in publication.
