NOTICE OF SUBSTITUTED TRUSTEE'S SALE
WHEREAS, on 02/17/2005, WILLIE J. GIBSON AND GERTRUDE GIBSON executed a Promissory Note payable to the order of AMERIQUEST MORTGAGE COMPANY.
WHEREAS, the aforesaid Promissory Note was secured by a Deed of Trust dated 02/17/2005, executed by WILLIE J. GIBSON AND WIFE, GERTRUDE GIBSON and being recorded on 03/02/2005 in Book 6222, Page 704 as Document No. 0949615 of the records of the Hinds County, State of Mississippi; and which aforesaid Instrument conveys to JIM B. TOHILL, Trustee and to AMERIQUEST MORTGAGE COMPANY, as Beneficiary, the hereinafter described property; and
WHEREAS, AMERIQUEST MORTGAGE COMPANY assigned said Deed of Trust to Deutsche Bank National Trust Company, as Trustee for ABFC 2005-AQ1 Trust, Asset-Backed Certificates, Series 2005-AQ1 via an instrument filed of record on December 30, 2025 as Document No. 1936240, in Book 7329, and at Page 9354 in the office of the Clerk of the Hinds County, State of Mississippi; and
WHEREAS, DEUTSCHE BANK NATIONAL TRUST COMPANY, AS TRUSTEE FOR ABFC 2005-AQ1 TRUST, ASSET-BACKED CERTIFICATES, SERIES 2005-AQ1 appointed WESTERN PROGRESSIVE - MISSISSIPPI, INC., as Substitute Trustee in the place of the aforementioned original Trustee via an instrument dated 02/26/2026 and recorded on 03/27/2026 in Book 7332, Page 809 as Document No. 1941020 of the Hinds County, State of Mississippi and
WHEREAS, default having occurred under the terms and conditions of said Promissory Note and Deed of Trust and the holder having declared the entire balance due and payable; and
WHEREAS, Western Progressive - Mississippi, Inc., the Substituted Trustee in said Deed of Trust will on 06/05/2026, between the hours of 11:00 a.m. and 4:00 p.m., offer for sale and will sell at public outcry to the highest bidder for cash at the North Front Door, Hinds County Courthouse (1st Judicial District), 407 East Pascagoula Street, Jackson, MS 39201, the following described property located and situated in Hinds County, Mississippi, to wit:
LOT 2, RIDGECREST SUBDIVISION, PART 2, A SUBDIVISION ACCORDING TO A MAP OR PLAT THEREOF WHICH IS ON FILE AND OF RECORD IN THE OFFICE OF THE CHANCERY CLERK OF HINDS COUNTY, MISSISSIPPI IN PLAT BOOK 12, PAGE 36, REFERENCE TO WHICH IS HEREBY MADE IN AID OF AND AS A PART OF THIS DESCRIPTION.
More commonly known as: 4135 CAROL DR, JACKSON, MS 39206
Subject to the rights of way and easement for public roads and public utilities, and to any prior conveyance or reservation of mineral of every kind and character, including but not limited to oil, gas, sand, and gravel in or under subject property.
As the undersigned Substituted Trustee, Western Progressive - Mississippi, Inc, will convey only such title as is vested in it under said Deed of Trust.
Please be advised that the trustee may require entity or trust bidders at this trustee’s sale to provide information, documentation and/or certification of the vesting instructions and the data required to be reported pursuant to FinCEN regulations effective for transfers of residential real property to covered transferees on or after March 1, 2026.
