NOTICE OF DECISION
On May 14, 2026, the City of Elizabeth Zoning Board of Adjustment (the "Zoning Board") adopted a Resolution granting applicant, Westminster HY, LLC (the "Applicant"), Amended Preliminary and Final Site Plan Approval, and Bulk "C" Variances, and affirmed the previously approved d(6) height variance, for the property located at 420-424 Westminster Avenue, Elizabeth, New Jersey, further identified as Block 151 Lot 1.02 on the Tax Maps of the City of Elizabeth (the "Property" or "Site").
The Zoning Board previously granted Preliminary and Final Major Site Plan approval on April 11, 2023 (the "Prior Approval"). The Prior Approval granted height variance relief along with a variety of associated bulk variances and design waivers, permitting the construction of a four (4) story, 44.25' tall multi-family residential building that would contain nineteen (19) apartment units (the "Building"), and various associated improvements, including a ground-level internal parking area. The current application amended the Prior Approval to facilitate the addition of two more one-bedroom apartment units within the Building. The addition of the two new units will be achieved by re-arranging the internal layout of the Building, and therefore there will be no changes to the Building's height or footprint.
For the current application, the Zoning Board approved the following variances:
Minimum Open Space: Required, 4,000 sq. ft.; Approved, 3,251 sq. ft.
Maximum Impervious Lot Coverage: Permitted, 60%; Approved, 83%
Additionally, the Zoning Board granted relief for the design waiver of:
Minimum Side Yard Setback for Parallel Parking Stalls: 3 ft. Required and 6" Approved (for 3 parking stalls).
