NOTICE OF PUBLIC HEARING
PLEASE TAKE NOTICE that upon the Application of Aqua New Jersey, Inc. (the "Applicant"), the Joint Land Use Board for the Township of Hardyston, acting in its capacity as a Zoning Boad of Adjustment (the "Board") shall conduct a public hearing on Monday, June 8, 2026, commencing at 7:00PM in the Council Chambers of the Hardyston Township Municipal Building, located at 149 Wheatsworth Road, Hardyston, New Jersey 07419, to consider a request for Conditional Use Variance Approval, Preliminary Major Site Plan Approval, Final Major Site Plan Approval, and Bulk Variance Approval to allow for the proposed addition of a 97.00+/- square foot utility enclosure, as part of the existing Hardyston Wallkill Well #4 Water Treatment Facility located on a 6.87+/- acre parcel on Ridgefield Road, within an R-5 Zoning District, and more particularly identified on the Official Tax Maps for the Township of Hardyston as Block 67.18, Lot 1.01 (the "Property").
Section 185-94 of the Hardyston Township Code allows public utility uses as conditionally permitted within an R-5 Zoning District, upon review and approval by the Planning Board pursuant to the standards and criteria ser forth in Article XVI of the Hardyston Township Code. Article XVI, at §185-58(I) ("Public Utility Uses") dictates the bulk and area criteria applicable to conditionally permitted public utility uses. Here, the following conditions are either existing non-conforming, or proposed to be non-conforming, for which the Applicant seeks Bulk Variance Approval and which therefore triggers the Applicant's request for Conditional Use Variance Approval: (i) an minimum lot area of 6.87+/- acres exists where 10 acres is otherwise required; (ii) a front yard setback of 46.1+/- feet for the utility enclosure is proposed, where 35.3+/- feet is existing, and 100 feet is otherwise required; and, (iii) a rear yard setback of 93.5+/- feet for the utility enclosure is proposed, where 80.1+/- feet is existing and 100 feet is otherwise required.
During the course of the review of the Application and / or presentation of the Application it is possible that bulk variances, submission waivers, design waivers, interpretations, and/or other exceptions from the requirements of the Hardyston Township Ordinances may be identified or deemed to be necessary to permit approval of the Application as submitted or with such changes as may be requested or accepted by the Board. This notice is to advise you that such additional approvals, variances, submission waivers, design waivers, interpretations, and/or other exceptions may be requested by the Applicant at the time of the Board hearing for this Application.
At the same time of the Board hearing on the Application, the Applicant will request that the Board grant any and all approvals, submission waivers, design waivers, bulk variances, interpretations, and any / all relief necessary to allow for the approval of the Application as submitted, or with such modifications as may be requested or accepted by the Board.
Anyone interested in this Application will have the opportunity to appear in person at the meeting of the Hardyston Township Joint Land Use Board on Monday, June 8, 2026, commencing at 7:00PM in the Council Chambers of the Hardyston Township Municipal Building, located at 149 Wheatsworth Road, Hardyston, New Jersey 07419, to present any support for, or objection to, the approval of this Application.
ACTION WILL BE TAKEN AT THIS MEETING. THIS MEETING WILL BE HELD IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT pursuant to N.J.S.A. 10:4-8(b).
The Board may at its discretion, adjourn, postpone, or continue the hearing from time to time, and you are hereby notified that you should make diligent inquiry of the Hardyston Township Land Use Administrator concerning such adjournments, postponements, or continuations.
