PUBLIC NOTICE
BOROUGH OF BEACH HAVEN
Public notice is hereby given that Carmine Timmoneri and Lisa Timmoneri (collectively, the "Applicant") have made application to the Beach Haven Land Use Board (the "Board") for bulk variances relative to proposed development at the property designated as Lot 1.01, Qualifier C0001, in Block 172 on the Tax Map of the Borough of Beach Haven, located at 235 Sixth Street. The property, which is located in the BD Business District, is currently developed with a side-by-side, two-family dwelling that has been converted to a condominium. The Applicant is the owner of Unit A, which is the northerly unit. The Applicant is constructing a small two-story addition on the northerly side of the existing dwelling. At the time that the dwelling was originally constructed, the maximum permitted impervious coverage at the property was 75%. Subsequent to the home being constructed, and after the Applicant purchased the property, the Borough of Beach Haven reduced the maximum permitted impervious coverage to 60%.
Section 212-27(B)(3)(a) of the Beach Haven Zoning Ordinance, which addresses impervious coverage, currently states as follows, in pertinent part: "Impervious lot coverage on any lot, including an area covered by any improvement, a permitted structure, swimming pool, deck or the like must maintain 40% of the area as open space and the maximum impervious cover shall be 60%." Here, the existing impervious coverage at the property is 68.8%. The Applicant is proposing to reduce the overall impervious coverage to 67.6%. Despite the fact that the impervious coverage is being reduced, a variance is required based upon the fact that the overall impervious coverage at the site will still exceed 60%. The Applicant is proposing to remove an existing hot tub and a section of pavers, which accounts for the reduction in the impervious coverage.
There are two additional preexisting nonconformities at the property that required variance relief:
The Applicant has an existing swim spa at the site, which under the Beach Haven Zoning Ordinance, is considered a swimming pool. The Borough's swimming pool ordinance has also changed since the Applicant purchased the property. Under Section 212-17(E)(5) of the Zoning Ordinance, inground swimming pools require a minimum side yard setback of 10 feet and a minimum rear yard setback of 8 feet. The existing side yard setbacks to the swim spa are 5.3 feet, 5.4 feet, and 5 feet. The Applicant is requesting that the existing swim spa be permitted to remain in its current location.
Under Sections 212-9(B)(3) and 212-9(E)(6) of the Zoning Ordinance, the minimum required side yard setback to accessory structures, including pergolas, is 5 feet. The southerly side yard setback to the existing pergola is 1.9 feet. The Applicant is requesting that the existing pergola be permitted to remain in its current location.
If the Board determines that any additional variances, waivers or exceptions are necessary or appropriate, then such variances, waivers, or exceptions will be requested at the hearing.
An in-person public hearing has been scheduled for June 1, 2026 at 6:00 p.m. in the Meeting Room at 300 Engleside Avenue, Beach Haven, New Jersey, at which time any interested persons may appear and have an opportunity to be heard on this application.
