PUBLIC NOTICE
BOROUGH OF BEACH HAVEN
Public notice is hereby given that Timothy J. Nemeth and Cathy Nemeth (collectively, the "Applicant") have made application to the Beach Haven Land Use Board (the "Board") for bulk variances and special reasons variances relative to proposed development at the property designated as Lot 12 in Block 60 on the Tax Map of the Borough of Beach Haven, located at 223 Pelham Avenue. The property, which is located in the RB Two-Family Residential District, is currently developed with two separate homes. There is a two-story, two-family dwelling situated toward the front of the property, and a separate one-story, single-family cottage situated toward the rear of the property. The Applicant is seeking to demolish the existing two-family dwelling and to construct a new single-family dwelling in a similar location to the existing two-family dwelling. There are no proposed modifications to the single-family cottage toward the rear of the property. The following variances are requested from the Beach Haven Zoning Ordinance:
Section 212-12(B)(2): In the RB Two-Family Residential District, the minimum required lot area for a two-family dwelling is 10,000 square feet, and the minimum required lot width is 100 feet. The subject property contains a lot area of 5,000 square feet and lot width of 50 feet. Additionally, under the Zoning Ordinance, a two-family dwelling is required to be contained withing one building. The Applicant is proposing to have two separate single-family dwellings.
Section 212-9(F): The maximum permitted lot coverage is 35%. The existing lot coverage is 45.8%; the proposed lot coverage is 48.2%.
Section 212-27(B)(3)(a): The maximum permitted impervious coverage is 60%. The existing impervious coverage is 73.5%; the proposed impervious coverage is 71%.
Section 212-21(C): All multistory residential buildings, except for hotels and motels, shall contain a combined total habitable floor area equal to not more than 50% of the area of the lot on which such building is situated. The existing floor area ratio is 45.5%; the proposed floor area ratio is 54.4%.
Section 212-23(A)(1): Every building shall provide off-street parking spaces comprising not less than 162 square feet of parking stall which shall have dimensions of not less than nine feet in width and not less than 18 feet in length which shall be located outside the vertical plane of the outside walls of any building and which parking spaces shall be accessible from a public way. There are 4 total off-street parking spaces required. While the Applicant is providing 4 off-street parking spaces, 2 of the proposed spaces encroach into the vertical plane of the outside walls of the proposed single-family dwelling.
The following nonconformities exist relative to the existing single-family cottage, which are not changing:
Section 212-9(E)(4): The minimum required rear yard setback is 8 feet. The rear yard setback to the existing single-family cottage is 3.1 feet, which is not changing.Section 212-9(E)(5): The minimum required combined side yard setback is 16 feet. The combined side yard setback relative to the existing single-family cottage is 12.1 feet, which is not changing.
Section 212-27(B)(5): A pervious surface area with a minimum width of 18 inches shall be provided between any impervious surface and the side yard and rear yard property lot lines. The 18-inch pervious area is not required for driveways with a minimum six-inch-high curbline along the side of a driveway abutting a property lot line. A portion of the existing ground-level deck adjacent to the existing single-family cottage is within 18 inches of the easterly property line.
If the Board determines that any additional variances, waivers or exceptions are necessary or appropriate, then such variances, waivers, or exceptions will be requested at the hearing.
An in-person public hearing has been scheduled for June 1, 2026 at 6:00 p.m. in the Meeting Room at 300 Engleside Avenue, Beach Haven, New Jersey, at which time any interested persons may appear and have an opportunity to be heard on this application.
Participation in the meeting will also be permitted remotely via Zoom. To access the virtual hearing, you must join the Zoom meeting.
