LEGAL NOTICE
MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Globe Street Management, LLC to Advanced Flower Capital Management, LLC, dated May 22, 2020 and recorded at Bristol County (Fall River District) Registry of Deeds on June 15, 2020, in Book No. 10134, at Page 200, of which mortgage the undersigned is the present holder Advanced Flower Capital Management, LLC, for breach of the conditions of said mortgage and for the purpose of foreclosing same will be sold at public auction at 1:00 PM, on June 18, 2026 on the mortgaged premises being known as 482 Globe Street, 508 Globe Street, 999 Broadway, Fall River, MA, being all and singular the premises described in said mortgage to wit:
(I) 482 GLOBE STREET, (2) 508 GLOBE STREET, AND (3) 999 BROADWAY FALL RIVER, MASSACHUSETTS
Parcel I
The land in Fall River, Bristol County, Massachusetts, together with all buildings and improvements thereon, situated on the Northerly side of Globe Street, bounded and described as follows:
WESTERLY by land now or formerly of the Fall River Industrial Buildings, Inc., one hundred fifty and 42/100 (150.42) feet; NORTHERLY by land now or formerly of B.M.C Durfee Trust Company, one hundred six and 52/100 (106.52) feet; EASTERLY by the Westerly line of a way, and other land of B.M.C Durfee Trust Company, one hundred fifty (150) feet; and SOUTHERLY by Globe Street, ninety-five and 26/100 (95.26) feet, more or less, both ends of said last mentioned line being marked by drill holes, containing approximately fifty-five and 587/1000 (55.587) square rods of land, more or less.
Together with the right in common with the B.M.C. Durfee Trust Company, its successors and assigns, and others entitled thereto, to pass and repass with vehicles or otherwise over a fifteen (15) foot strip east of an adjoining and granted premises from Globe Street to the northerly line of the granted premises.
Subject to the rights of others to the stream flowing through said land, and the water therein and the control of the flow thereof.
PARCEL II:
The land in Fall River, Bristol County, Massachusetts, with all the buildings and improvements thereon, being bounded and described as follows:
BEGINNING at the southeasterly comer of the land to be described, at the point where the westerly line of Broadway intersects the northerly line of Globe Street; thence running northerly by the westerly line of Broadway, one hundred eight and 90/100 (108.90) feet; thence westerly on a line parallel with the northerly line of Globe Street, one hundred two and 52/100 (102.52) feet; thence southerly in a line parallel with the westerly line of Broadway, one hundred eight and 90/100 (108.90) feet to Globe Street; thence easterly by Globe Street, one hundred two and 52/100 (102.52) feet to the point of beginning. Containing forty and 25/100 (40.25) square rods of land, more or less.
EXCLUDING THEREFROM, so much of the above described premises as was conveyed by Sophie Kocon to
Walter Kocon by Deed dated March 19, 1975, and is recorded with the Bristol County Fall River District Registry of Deeds in Book 1112, Page 362.
PARCEL III
The land in Fall River, Bristol County, Massachusetts, with the buildings thereon bounded and described as follows:
Beginning at a point on the northeasterly side of Globe Street at a spike set in the ground, which spike is 34.16 feet west, as measured in the northeasterly line of said Globe Street, from a spike set in the ground on the northeasterly side of said Globe Street marking the end point of curvature at the northwest corner of Globe Street and Broadway; thence running by said Globe Street North 44° 21' 40" West on hundred twenty and 6/100 (120.06) feet to a spike set in the ground; thence turning and running North 32° 54' 50" East ninety two and 54/100 (92.54) feet to a spike; thence turning and running South 57° 05' 10" East seventy-six and 5/100 (76.05) feet to a drill hole set in a wall; thence turning and running South 32° 54' 50" West no and 84/100 (00.84) feet to a point; thence turning and running South 44° 21' 40" East forty-two and 9/100 (42.09) feet to a spike set in the ground; thence running and running South 32° 54' 50" West one hundred eight and 90/100 (108.90) feet to the northeasterly side of Globe Street and the point of beginning. Containing 12,038 square feet of land, more or less.
Being the same premises as conveyed to the mortgagor by deed of Green Water Realty, LLC, dated April 20, 2018, recorded at Bristol County (Fall River District) Registry of Deeds on April 20, 2018 in Book No. 9489, at Page 232.
The above described premises will be sold SUBJECT TO and with the benefit of all restrictions, easements, covenants, conditions, building and zoning laws, to any and all unpaid taxes, tax titles, water and sewer charges, municipal or other public taxes, assessments or liens, rights of tenants and parties in possession, if any.
TERMS OF SALE:
A deposit of $75,000.00 DOLLARS shall be required to be made to the mortgagee in cash, by certified or by cashier's check at the time and place of the sale as a deposit. The successful bidder will be required to execute an Auction Sale Agreement immediately after the close of the bidding. The balance of the purchase price shall be paid in cash, by certified check, by cashier's check, or other check satisfactory to Mortgagee's attorney within thirty (30) days thereafter at the offices of BARSH AND COHEN, P.C., Attorneys for the Mortgagee, 500 Turnpike Street Suite 201, Canton, MA 02021, in exchange for which and at such time and place, the deed shall be delivered to the purchaser for recording.
The Mortgagee reserves the right to amend the foregoing terms of sale by written or oral announcement made before the auction sale, during the sale thereof or at the commencement of or during any postponed sale, the right to bid at the sale, to reject any and all bids, and to postpone the sale up until the time the property is declared sold by the auctioneer.
The description of the premises contained in said mortgage shall control in the event of an error in the Notice of Mortgagee's Sale or its publication.
