NOTICE OF MEETING
NEWTOWN TOWNSHIP ZONING HEARING BOARD
NOTICE is hereby given that the Newtown Township Zoning Hearing Board will hold a public meeting on Thursday, June 4, 2026, at 7:00 p.m. at the Township Municipal Building, 100 Municipal Drive, Newtown, PA 18940, to conduct a hearing on the following application and other such business properly before the Zoning Hearing Board:
1. Appeal 1250-26: Marc Dippolito, Applicant and Owner, requests the following zoning relief to permit construction of a sunroom addition and patio. The Applicant seeks variances from the Newtown Grant’s Final Plan and the Newtown Township Joint Municipal Zoning Ordinance of 2007, as amended, specifically variances from Newtown Grant’s Final Plan rear yard setback requirement to permit a rear yard setback of 15 feet and 2 inches where a minimum rear yard setback of 25 feet is required, Newtown Grant’s Final Plan impervious area requirement to permit an impervious coverage of 37.86% where a maximum impervious coverage of 30% is permitted, and a variance from Section 1000(E)(3)(b)(2) to permit a patio projection of 3 feet and 4 inches from the lot line where no patio shall be closer than 15 feet to any side or rear lot line. The Subject Property is located at 7 Chicory Place, Lot 430, Newtown Grant, Newtown, PA, Tax Map Parcel #29-19-272. The Subject Property is located in the R-2 High Density Residential District.
2. Appeal 1251-26: Bakul C. Patel & Sangita Patel, Applicants and Owners, request the following zoning relief to permit subdivision of the Subject Property and subsequent construction of a new single-family detached dwelling on the newly-created lot, with demolition of an existing veterinary office/clinic. Applicants seek variances from the Newtown Township Joint Municipal Zoning Ordinance of 2007, as amended, specifically variances from Section 502(B) to permit a lot width for Proposed Lot 2 of 187 feet where a minimum lot width of 200 feet is required, to permit a side yard setback of 20 feet where a minimum side yard setback of 50 feet is required, and to permit an impervious surface ratio of 8.3% where a maximum impervious surface ratio of 8% is permitted, and from Section 502(B) Footnote (3) to permit 1.2 dwelling units per acre where a maximum of 0.3 dwelling units are permitted per acre, and to permit a gross site area for Proposed Lot 2 of 52,330 square feet where a minimum gross site area of 130,680 square feet (3 Acres) is required. The Subject Property is located at 430 Durham Road, Newtown Township, Newtown, PA, Tax Map Parcel 29-3-36. The Subject Property is located in the R-2 High Density Residential and PS-2 Professional Service Districts.
3. Appeal 1252-26: Alex Mosendz, Applicant, and The Brown Mole, LLC (Owner), request the following zoning relief to permit partial demolition of an existing one (1) story single-family detached dwelling and reconstruction of a two (2) story single-family detached dwelling with an expanded footprint. Applicant seeks a special exception pursuant to and a variance from the Newtown Township Joint Municipal Zoning Ordinance of 2007, as amended, specifically a special exception pursuant to Section 1208(C)(2) to permit expansion or erection of a building on a nonconforming lot, and a variance from Section 401(C) to permit a front yard setback of 42 feet where a minimum front yard setback of 100 feet is required. The Subject Property is located at 361 Stoopville Road, Newtown Township, Newtown, PA, Tax Map Parcel #29-3-11-1-1. The Subject Property is located in the CM Conservation Management District.
4. Appeal 1253-26: Shelby Reinstein and Garret Pachtinger, Applicants and Owners, request the following zoning relief to permit construction of a front deck, porch roof, and walkway. Applicants seek a special exception pursuant to and a variance from the Newtown Township Joint Municipal Zoning Ordinance of 2007, as amended, specifically a special exception pursuant to Section 1208(C)(2) to permit expansion or erection of a building on a nonconforming lot, and a variance from Section 401(C) to permit a building coverage of 16.9% where a maximum building coverage of 15% is permitted. The Subject Property is located at 3 Millstone Drive, Lot 2, Penns Preserve, Newtown, PA, Tax Map Parcel #29-48-25. The Subject Property is located in the CM Conservation Management District.
5. Appeal 1254-26: Knights of Pythias, Defiance Lodge #335, Applicant and Owner, requests the following zoning relief to permit redevelopment of the Subject Property from a clubhouse, parking lot, and two (2) single-family detached dwellings into a new clubhouse with a larger parking lot. Applicant seeks a special exception pursuant to and variances from the Newtown Township Joint Municipal Zoning Ordinance of 2007, as amended, specifically a special exception pursuant to Section 1208(C)(2) to permit expansion or erection of a building on a nonconforming lot, and variances from Section 405(B) to permit an impervious surface ratio of 62.7% where a maximum impervious surface ratio of 35% is permitted, Section 405(C) to permit a front yard setback from Linden Avenue of 18.5 feet and from German Avenue of 65.7 feet where a minimum front yard setback of 100 feet is required, Section 803(C)(C-8)(3) to permit sixty (60) off-street parking spaces where a minimum of one-hundred and twenty (120) off-street parking spaces are required, Section 1001(B)(3) to permit parking spaces of dimensions 9’x18’ where parking spaces must be at least 10’x20’, and Section 1002(I) to permit no loading berths where a minimum of two (2) loading berths are required. The Subject Property is located at 57 Swamp Road, 87 Linden Avenue, & 62 German Avenue, Newtown Township, Newtown, PA, Tax Map Parcels 29-11-60, 29-11-61, and 29-11-63-1, respectively. The Subject property is located in the R-2 High Density Residential District.
