RESOLUTION [To Set a Public Hearing to Declare the Abundance of Overgrown Grass and Weeds at 480 Mt Airy Drive, 1175 Josephine Avenue, 214 Woodvale Road, 348 Doster Street, 138 Lina Drive, and 609 Allenville Road to be Unsafe and a Public Nuisance and Order Its Abatement Pursuant to Chapter 46 et seq., City of Prattville Code of Ordinances.] WHEREAS, an abundance of overgrown grass and weeds: 1. is injurious to the public health, safety, and general welfare of the community by providing a breeding ground and shelter for rats, mice, snakes, mosquitoes, and other vermin; 2. may cause the further spread of weeds; 3. may hide debris, such as glass or metal, that could inflict injury on a person going to such property; 4.may also pose a fire hazard and respiratory hazard; and WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected the properties, and determined the existence of an abundance of overgrown grass and weeds at 480 Mt Airy Drive, 1175 Josephine Avenue, 214 Woodvale Road, 348 Doster Street, 138 Lina Drive, and 609 Allenville Road; and WHEREAS, the Autauga County tax records list the property owner(s) as follows: 480 Mt Airy Drive - Lett Richard Revell Jr and Tiffany, with an address of 480 Mt Airy Drive, Prattville, AL 36067, to Parcel Number 19 02 09 2 001 001.034; and 1175 Josephine Avenue - Opel John B with an address of 1175 Josephine Avenue, Prattville, AL 36066, to Parcel Number 19 05 15 1 004 005.000; and 214 Woodvale Road – Cruz Abraham David & Stephanie, with an address of 214 Woodvale Road, Prattville, AL 36067, to Parcel Number 19 02 09 1 008 026.000; and 348 Doster Street - Stoudenmire Sherwood A c/o Lanier Investments LLC, with a mailing address of 4267 Lomac Street, Montgomery, AL 36106, to Parcel Number 19 05 16 2 000 190.000; and 138 Lina Drive - Brown Bradford W and Glenda D Brown, with an address of 138 Lina Drive, Prattville, AL 36067, to Parcel Number 19 05 16 4 006 051.000; and 609 Allenville Road - Allen Anthony, with a mailing address of 1371 Highway 82 W, Prattville, AL 36067, to Parcel Number 19 03 07 4 001 011.000; and WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the Code Enforcement Officer gave written notice to the owner(s) of said properties on April 17, 2026, April 20, 2026, April 20, 2026, April 22, 2026, April 27, 2029, and April 29, 2026, respectively, to correct, remedy, or remove the abundance of grass and weeds within ten (10) days; and WHEREAS, the owner(s) of said properties have failed and/or refused to correct, remedy, or remove said condition by the expiration of said notice; and WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, permits the City Council to declare the abundance of overgrown grass and weeds to be a public nuisance and abate the same; and WHEREAS, pursuant to Section 46-114 (e), City of Prattville Code of Ordinances, declaring the abundance of overgrown grass and weeds to be a public nuisance and ordering their abatement by the City Council initiates a fine for the first violation and designation on the repeat offender registry. NOW, THEREFORE, BE IT RESOLVED THAT: the City Council of the City of Prattville declares the abundance of overgrown grass and weeds at said properties to be a public nuisance and has therefore initiated the abatement process; and 1. the owner(s) of said properties are ordered to abate said nuisance and appear before the City Council at a Public Hearing at 6:00 p.m. on June 16, 2026, at Prattville City Hall; and 2. any objections may be filed, in writing, to the City Clerk at least five (5) days prior to the Public Hearing; and 3. the fine of $100.00 shall be assessed to the owner(s) of said properties in addition to any costs incurred for the abatement process; and 4. said properties shall be placed on the repeat offender registry for a period of three (3) years; and 5. the notice of Public Hearing on the matter, as required by law, will be provided in a publication of general circulation, by certified mail, and by signage on the subject properties.
