TO: Joanne Makris, now or formerly of Roseland, in the State of Florida, or her known and unknown heirs, devisees or legal representatives.
You are hereby notified that a complaint has been filed by the above-named plaintiff in which you are named as an interested party. This complaint concerns a certain property in Chicopee, in the County of Hampden, in said Commonwealth being known as and numbered 82 Jennings Street, as described in a deed dated June 8, 1996 and recorded on September 11, 1996 (the "Deed") with the Hampden County Registry of Deeds ("the Registry"), in Book 9617, Page 259 (the "Property"); title to said property is clouded by an unauthorized deed of record. On August 3, 1950, Florence M. Makris ("Florence") acquired title to the Property pursuant to a deed dated August 3, 1950 and recorded with the Registry in Book 2063, Page 384. On January 11, 1992, Florence died testate and Catherine Derosia ("Catherine") was appointed as Florence's Executrix. Plaintiff alleges that through Article Third of Florence's Will, Florence devised all of her property, real and personal to her four children who survived her in equal shares but on the condition that the Property would be sold to her son, Stanley Adamczyk, Jr. at its fair market value if he desired to purchase it. Catherine, in her capacity as Executrix of Florence's Estate conveyed the property to John Adamczyk ("John") for $40,000.00 through the Deed. Plaintiff alleges that Florence's Will did not contain a Power of Sale and Catherine did not seek a License to sell in the Probate and Family Court, Hampden Division prior to the Deed. On or about March 13, 2006, John executed a promissory note and granted a mortgage to New Century Mortgage Corporation as recorded with the Registry in Book 15754, Page 281 (the "Mortgage"). On or about May 21, 2021, the Mortgage was assigned to the plaintiff pursuant to an assignment of mortgage recorded with the Registry in Book 20185, Page 455, purportedly as affected by a confirmatory assignment of mortgage recorded with the Registry in Book 23878, Page 92. Plaintiff alleges that Catherine, as Executrix under Florence's Will, lacked the authority to convey the Property to John. Plaintiffs seek a Judgment quieting title to the Property to John; confirming that that the Deed was valid and conveyed good clear, marketable title to the Property; and that the Plaintiff holds a valid mortgage interest in the Property.

If you intend to make any defense, you are hereby required to serve upon the plaintiff's attorney, Thomas J. Flaherty, Esq., of Bacon Flaherty, LLC, at 15 South Main Street, Randolph, MA 02368, an answer to the complaint on or before the twenty-ninth day of June, 2026, next, the return day, hereof, and a copy thereof must be filed in this court on or before said day.
If you fail to do so, judgment by default will be taken against you for relief demanded in the complaint. Unless otherwise provided by Rule 13(a), your answer must state as a counterclaim any claim which you may have against the plaintiff which arise out of the transaction or occurrence that is the subject matter of the plaintiff's claim, or you will thereafter be barred from making such claim in any other action.
It is ORDERED that notice be given by publishing a copy of this notice once in the Florida Today, a newspaper of general circulation Roseland, Florida, at least thirty days before the twenty-ninth day of June, 2026.
