vs.
ESTEBAN GARCIA, a married man, as his sole and separate property; SECRETARY OF HOUSING AND URBAN DEVELOPMENT, a governmental entity; THE UNKNOWN HEIRS AND DEVISEES OF ESTEBAN GARCIA, IF DECEASED, Defendant(s).
UNDER AND BY VIRTUE OF EXECUTION AND ORDER OF SALE issued out of and under the seal of Superior Court of Maricopa County, State of Arizona, on the 18th day of March, 2026, and to me as Sheriff of said County duly directed and delivered in the above entitled action:
WHEREAS, on the 25th day of August, 2023, the above-named Plaintiff recovered a Judgment in the above-styled court against the Defendant, above-named, as follows:
Amounts awarded in judgment, accruing interest at rate stated in judgment -- $22,460.83; Pre-judgment interest -- $2,073.06; 2024 and 2025 assessment -- $3,142.27; Late charges -- $330.00; Trash assessments -- $489.27; Rural Metro Assessments -- $1,284.02; Interest accrued on judgment through March 5, 2026 -- $5,186.63; Supplemental attorney fees and costs pending Court approval -- $4,622.69; Less credits or payments applied -- ($23,533.26); Total judgment balance as of March 5, 2026 -- $16,055.51.
Interest will continue to accrue at the rate of $1.39 per diem from March 6, 2026, plus monthly late charges, plus monthly rural metro assessments of $141.42 and monthly trash assessments of $18.89 commencing April 2026. Additional assessments will accrue January 1, 2027 in an amount not less than $1,094.40, plus costs of Sheriff’s Sale, together with a foreclosure of Plaintiff’s lien against the Defendant, on the following described real property, to-wit:
Lot 123, of DREAMING SUMMIT UNIT 2B, according to the plat of record in the office of the County Recorder of Maricopa County, Arizona, recorded in Book 541 of Maps, Page 48.
AKA: 13829 West San Miguel Avenue, Litchfield Park, Arizona 85340.
NOW, THEREFORE, PUBLIC NOTICE IS HEREBY GIVEN that on the 11th day of June, 2026, at the hour of 10:00 A.M. at 301 West Jefferson Street, Room 250-8*, in the City of Phoenix, Maricopa County, State of Arizona, I will in obedience to said Execution and Order of Sale, sell all the right, title, claim and interest of the above named debtor, in, of and to the above described property at public auction to the highest bidder for cash or certified funds only, in lawful money of the United States, and apply the proceeds thereof to the payment and satisfaction of said judgment, together with the interest that may be due thereon and all costs of suit and accruing costs.
