NOTICE OF COMPLAINT FOR SALE OF REAL ESTATE TO PAY DEBTS AND AVOID THE SUFFERING OF WASTE
TO: Unknown spouse, next-of-kin, and lineal descendants, if any, of Edith M. Parry: The above-named individuals, whose current residences are unknown, and, if deceased, their unknown heirs and devisees whose addresses are also unknown, are hereby notified that a Complaint for Sale of Real Estate to Pay Debts and Avoid the Suffering of Waste has been filed by Angela Seimer Marvin, Guardian of the Estate of Edith Marie Parry, an incompetent person, Case No. PC20260006 of the Probate Court of Fairfield County, Ohio, on the following described real estate:
Situated in the Township of Clearcreek, County of Fairfield and State of Ohio: Being the South one-half of the Southeast quarter of Section Two (2), Township Twelve (12), Range Twenty (20), containing seventy-nine and 63/100 acres, more or less. EXCEPTING FROM THE ABOVE DESCRIPTION THE FOLLOWING TRACTS as deeded out to Craig Allen David and Penny Anne Davis in Deed Volume 505, Page 603 and described as follows:
TRACT "A" Beginning at a ¾ inch pin found at the Southeast corner of Section 2; thence West on the South line of said Section 2661.80 feet to a railroad spike set at the Southwest corner of said quarter section and in the center of Amanda-Southern Road; thence North 00 degrees 41' West with the center of said road 651.40 feet to a railroad spike; thence South 89 degrees 54' East 600.00 feet to a ½ inch pipe, passing a ½ inch pipe at 20.0 feet; thence North 00 degrees 41' West 655.00 feet to a ½ inch pipe; thence South 89 degrees 54' E 2074.10 feet to a point in Clearcreek on the East line of the above mentioned quarter section; thence South 00 degrees 09' E on said section line 1301.60 feet to the place of beginning; containing 70.84 acres more or less and being subject to all legal rights-of-way of record, if any.
TRACT "B" Beginning at a point in Clearcreek on the East line of the above mentioned quarter section, which bears N 00 degrees 09' W 1301.60 from the Southeast corner of said quarter section; thence N 89 degrees 54' W 23.10 feet (0.35 chains) to a point in Clearcreek; thence N 00 degrees 09' W parallel to the east line of said quarter section 551.10 feet (8.35 chains) to a point; thence S 89 degrees 54' E 23.10 feet (0.35 chains) to a point in the East line of said quarter section; thence S 00 degrees 09' E on said section line 551.10 feet (8.35 chains) to the place of beginning; containing 0.29 acre more or less and being subject to all legal rights of way of record, if any. EXCEPTING FROM THE ABOVE DESCRIPTION THE FOLLOWING TRACT: Being part of the 9.02 acre tract described in Deed Volume 572, Page 498, and being more fully described as follows:
Beginning at a point in Amanda-Southern Road and on the West line of the aforementioned 9.02 acre tract, said point located North 00 °41'00" West to a distance of 1041.70 feet from a railroad spike found at the Southwest corner of the Southeast Quarter of Section 2; Thence with Amanda-Southern Road North 00°41'00" West to a distance of 264.70 feet to a railroad spike found at the Northwest corner of the 9.02 acre tract; Thence South 89°54'00" East, passing a 5/8 inch rebar previously set at 50.00 feet, a total distance of 599.84 feet to a 5/8 inch iron pipe found at the northeast corner of the 9.02 acre tract; Thence with the East line of the 9.02 acre tract South 00°41'21" East to a distance of 308.21 feet to a 5/8 inch rebar set; Thence North 87°03'20" West a distance of 432.59 feet to a 5/8 inch rebar set; Thence North 06°00'04" West a distance of 22.70 feet to a 5/8 inch rebar set; Thence South 89°54'57" West, passing a 5/8 inch rebar set at 136.00 feet, a total distance of 166.00 feet to the point of beginning, containing 3.969 acres. Bearings are based on a previous survey filed in Survey Book 39, Page 11932. Rebars set are 5/8 inch by 30 inches and have a yellow plastic identification cap stamped "Tobin-McFarland". For additional information see plat of survey made in conjunction with and considered an integral part of this description. This description is based on a survey made in April of 2009, by Tobin-McFarland Surveying, Inc., and was prepared by Rodney McFarland, Registered Professional Surveyor No. 6416. Subject to conditions, restrictions, easements, and utility rights of way of record. Reference is hereby made to Vol. Book 572 Page 498 and Vol. 1675 Page 4198-4199 Commonly known as: 6850 and 6860 Amanda-Southern Rd. SW, Amanda OH 43102 Parcel ID# 011-00014.00
Defendants are required to set up any interest that they may have in said premises or be forever barred; that upon failure of Defendants to establish any such interest, said premises may be sold free and clear of all claims, liens, and interest of any parties herein. Said Defendants will take notice that they will be required to answer said Complaint on or before July 10th, 2026 the or judgment will be rendered accordingly.
