NOTICE OF MORTGAGEE’S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Kenneth R. Howatt and Kathy J. Light to TD Banknorth, N.A. dated May 23, 2005 and recorded with the Middlesex County (Southern District) Registry District of the Land Court at Document No. 01383271 and noted on Certificate of Title No. 0216557, of which mortgage the undersigned is the present holder, TD Banknorth, National Association changed its name to TD Bank, National Association on May 31, 2008, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 11:00 a.m. (ET) on the 16th day of June, 2026, on the mortgaged premises located at 36 Rathbun Road, a/k/a 36 Rathburn Road, Natick, Massachusetts, all and singular the premises described in said mortgage.
TO WIT: The following described property is situated in Natick, County of Middlesex and Commonwealth of Massachusetts:
That certain parcel of land situate in NATICK, in the county of Middlesex, Commonwealth of Massachusetts, described as follows:
Northwesterly by Rathbun Road, two hundred twenty-one and 96/100 feet;
Northeasterly by land now or formerly of Hugh R. White et. al., two hundred three and 80/100 feet;
Southeasterly by lands now or formerly of Kensington Enterprises, Inc. and of Douglas T. Newman, Trustee, one hundred eighty-four and 46/100 feet; and
Southwesterly by land now or formerly of Edward J. Enright, one hundred and eighty feet.
All of said boundaries are determined by the Court to be located as shown on a plan, as modified and approved by the Court, filed in the Land Registration Office, a copy of a portion of which is filed in the Registry of Deeds for the South Registry District of Middlesex County in registration Book 659, Page 136, with certificate 105886, (Pan No. 30696A).
Being the same property conveyed to Kathy J. Light and Kenneth R. Howatt, husband and wife, as tenants by the entirety by deed from Kathy J. Light and Kenneth R. Howatt, as joint tenants recorded 10/27/1999 in deed document no. 1122252, in the Registry of Deeds Plan for Middlesex County, Massachusetts.

Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
Terms of sale: A deposit of five thousand dollars ($5,000.00) by certified or bank check made payable to TD Bank, N.A. will be required to be paid by the purchaser at the time and place of sale. TD reserves the right to reject any and all bids at any time. The balance is to be paid by certified or bank check payable to TD Bank, N.A. c/o Duane Morris LLP, 2 Monument Square, Suite 505, Portland, ME 04101-4097, within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price.
