MORTGAGEE'S SALE OF REAL ESTATE
By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Jeffery Utley and Jennifer L. Utley to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Guaranteed Rate, Inc., its successors and assigns, dated October 27, 2021 and recorded in Plymouth County Registry of Deeds in Book 55943, Page 242 (the “Mortgage”) of which mortgage Selene Finance LP is the present holder by Assignment from Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Guaranteed Rate, Inc., its successors and assigns to JPMorgan Chase Bank, National Association dated July 29, 2024 and recorded at said Registry of Deeds in Book 59147, Page 287, and Assignment from JPMorgan Chase Bank, National Association to Selene Finance LP dated October 23, 2024 and recorded at said Registry of Deeds in Book 59390, Page 88, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 9 McFarlin Road, Carver, MA 02330 will be sold at a Public Auction at 1:00 PM on June 15, 2026, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
A certain parcel of land, with the buildings thereon, lying on the Northwesterly and Westerly side of Mcfarlin Road, in Carver, Plymouth County, Massachusetts, being more particularly bounded and described as follows:
SOUTHEASTERLY, EASTERLY and NORTHEASTERLY by Mcfarlin Road, as shown on said Plan hereinafter described, two-hundred twenty-one and 53/100 (221. 53) feet;
SOUTHWESTERLY by lot 20, as shown on said plan, by two courses, aggregating one hundred eighty-four and 38/100 (184.38) feet;
NORTHWESTERY by land now or formerly of Harold W. & Ethel M. Beal, as shown on said plan, one hundred thirty-nine and 69/100 (139.69) feet;
NORTHWESTERLY again by land now of formerly of Potenza et ux, as shown on said plan, one hundred six and 99/100 (106.99) feet;
NORTHWESTERLY again by land now or formerly of said Potenza et ux, as shown on said plan, eighty-nine (89) feet, more or less.
Containing 22,500 square feet, and being shown as lot 19 on a plan entitled "Definitive Plan" McFarlin Road Extension "Cranberry Heights", Carver Harold W. Beal & Ethel M. Beal M.T.
Shaw - Halifax - R.L.S. 1 June 1967 Scale I inch = 40 feet', which plan is recorded with Plymouth County Registry of Deeds in Plan Book 16, Page 797.
For mortgagor’s title see deed recorded with the Plymouth County Registry of Deeds in Book 53081, Page 168.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee.
