NOTICE OF SALE
NOTICE IS HEREBY GIVEN that on July 29, 2026, at the hour of 10:00 AM, the undersigned Special Master, or his designee, will, at the front entrance of the Dona Ana County Courthouse, at 201 West Picacho, Las Cruces, New Mexico 88005, sell all of the rights, title, and interests of the above-named Defendant, in and to the hereinafter described real property to the highest bidder for cash. The property to be sold is located at 18614 South Highway 28, La Mesa, New Mexico 88044, and is more particularly described as follows:
A tract of land situate South of San Miguel, Dona Ana County, New Mexico in Section 10, Township 25 South, Range 2 East, N.M.P.M. of the U.S.R.S. Surveys. Being U.S.R.S. Tract 18A-84A2 and more particularly described as follows, to wit:
BEGINNING at a 5/8 inch rebar found for the Northwest corner of Lot 1, Block 'A' of Alto De Las Flores Plat #3 (Plat filed November 20, 1975 in Plat Record 12, Page 23 of the Records of Dona Ana County, New Mexico) and the Southwest corner of the tract herein described;
THENCE FROM THE POINT OF BEGINNING along the East side of New Mexico State Highway 28 North 63 deg 49 min 00 sec West, 110.89 feet to a 5/8 inch rebar set on the North side of a block wall for Northwest corner of the tract herein described;
THENCE leaving the highway and partially along a block wall and partially along a wire fence North 55 deg 39 min 20 sec East, 176.65 feet to a 1/2 inch iron rod for the Northeast corner of the tract herein described;
THENCE leaving the fence South 55 deg 37 min 40 sec East, 108.89 feet to a 5/8 inch rebar set on the North boundary of Alto De Las Flores Subdivision and for the Southeast corner of the tract herein described;
THENCE along the North boundary of said subdivision and along a wire fence S.57 deg 24 min West, 161.69 feet to the point of BEGINNING, containing 0.3817 acre of land more or less,

including any improvements, fixtures, and attachments, such as, but not limited to, mobile homes (hereinafter the "Property"). If there is a conflict between the legal description and the street address, the legal description shall control.
The foregoing sale will be made to satisfy a foreclosure in rem judgment rendered by this Court in the above-entitled and numbered cause on May 7, 2026, being an action to foreclose a mortgage on the Property. Plaintiff's in rem judgment is in the amount of $149,778.07, and the same bears interest at the rate of 5.2500% per annum, accruing at the rate of $21.54 per diem. The Court reserves entry of final in rem judgment as to Defendant, Makayla Kocsis aka Makayla Rushton Kocsis, Personal Representative of the Estate of April Kocsis aka April Marie Kocsis, Deceased, for the amount due after foreclosure sale, including interest, costs, and fees as may be assessed by the Court. Plaintiff has the right to bid at the foregoing sale in an amount equal to its in rem judgment, and to submit its bid either verbally or in writing. Plaintiff may apply all or any part of its in rem judgment to the purchase price in lieu of cash.
In accordance with the Court's decree, the proceeds of sale are to be applied first to the costs of sale, including the Special Master's fees, and then to satisfy the above-described judgment, including interest, with any remaining balance to be paid unto the registry of the Court in order to satisfy any future adjudication of priority lienholders.
NOTICE IS FURTHER GIVEN that in the event that the subject Note and Mortgage is not sooner paid off or reinstated, the undersigned Special Master will, as set forth above, offer for sale and sell the Property to the highest bidder for cash or equivalent, for the purpose of satisfying, in the adjudged order of priorities, the judgment and decree of foreclosure described herein, together with any additional costs and attorney's fees, including the costs of advertisement and publication for the foregoing sale, and, reasonable receiver and Special Master's fees in an amount to be fixed by the Court. The amount of the judgment due is $149,778.07, plus interest to and including date of sale in the amount of $2,929.44, for a total judgment of $152,707.51.
The foregoing sale may be postponed and rescheduled at the discretion of the Special Master, and is subject to all taxes, utility liens and other restrictions and easements of record, and subject to a one (1) month right of redemption held by the Defendant upon entry of an order approving sale, and subject to the entry of an order of the Court approving the terms and conditions of sale.
