FORECLOSURE NOTICE
Default having been made by failure to comply with the terms and conditions of (i) those certain Promissory Notes, dated as of August 31, 2023, executed by The Ward Organization LLC, a Delaware limited liability company, as Borrower (the “Borrower”); (ii) the Term Loan Agreement, dated as of August 31, 2023, by and among Borrower, the lenders party thereto (the “Lenders”), and Stonebriar Commercial Finance LLC, a Delaware limited liability company, as administrative agent (the “Agent”); and (iii) the Deed of Trust, Assignment of Rents, Security Agreement and Fixture Filing (the “Deed of Trust”), dated as of August 31, 2023, executed by Borrower, to secure the indebtedness, payable to the Agent, of record as Instrument No. 20230929-0076778, Register's Office for Davidson County, Tennessee.
Whereby in the Deed of Trust, Borrower conveyed the property therein described to Matt Foster, Trustee, to secure the indebtedness therein described, and the entire indebtedness having been declared due and payable as provided in the Deed of Trust, and payment not having been made as demanded, and the undersigned, J. Steven Kirkham of Davidson County, Tennessee, having been appointed as Substitute Trustee in the place and stead of Matt Foster, by Appointment of Substitute Trustee of record as Instrument No. 20260427-0036131, said Register’s Office, notice is hereby given that I, J. Steven Kirkham, Substitute Trustee, having been requested so to do by the lawful owner of said indebtedness, will on June 18, 2026, at 12:00 pm prevailing Central Time, in front of the Davidson County Courthouse door located at One Public Square, Nashville, Davidson County, Tennessee, sell at public sale, to the highest bidder for cash, in bar of the right, title, interest, claim, equity, equity of redemption, statutory right of redemption, and demand whatsoever, either at law or in equity and all other rights and exemptions of every kind, all of which are expressly waived, in the following described land and any improvements thereon:
