NOTICE OF SALE UNDER POWER
Under and by virtue of the power of sale contained with that certain Security Deed dated April 17, 2023, from Lydia Alcaraz and Andrew N. Sutphen to Mortgage Electronic Registration Systems, Inc., as nominee for HomeBridge Financial Services, Inc. dba Real Estate Mortgage Network, its successors and assigns, recorded on May 2, 2023 in Deed Book 3084 at Page 176, Partial Claims Mortgage deed book 3426 or Page 531-536 Chatham County, Georgia records, having been last sold, assigned, transferred and conveyed to Lakeview Loan Servicing, LLC by Assignment and said Security Deed having been given to secure a note dated April 17, 2023, in the amount of $281,346.00, and said Note being in default, the undersigned will sell at public outcry during the legal hours of sale before the door of the courthouse of Chatham County, Georgia, on July 7, 2026 the following described real property (hereinafter referred to as the “Property”):
ALL THOSE CERTAIN LOTS, TRACTS OR PARCELS OF LAND SITUATE, LYING AND BEING IN THE CITY OF SAVANNAH, CHATHAM COUNTY, GEORGIA, AND KNOWN UPON THE MAP OR PLAN OF SAID CITY AS LOT TWO HUNDRED THIRTEEN (213) AND THE WESTERN TEN (10) FEET OF LOT TWO HUNDRED TWELVE (212), PURSE WARD. SAID LOT AND PORTION OF LOT ARE CONTIGUOUS AND TOGETHER HAVE A COMBINED SOUTHERLY FRONTAGE OF 40 FEET ON 32ND STREET WITH A RECTANGULAR DEPTH NORTHWARDLY OF 100 FEET TO A LANE AND AS A WHOLE ARE BOUNDED ON THE NORTH BY SAID LANE, ON THE EAST BY THE REMAINING PORTION OF LOT 212, SAID WARD, ON THE SOUTH BY 32ND STREET AND ON THE WEST BY LOT 214, SAID WARD
The debt secured by the Security Deed and evidenced by the Note has been, and is hereby, declared due and payable because of, among other possible events of default, failure to make the payments as required by the terms of the Note. The debt remaining is in default and this sale will be made for the purposes of paying the Security Deed, accrued interest, and all expenses of the sale, including attorneys’ fees. Notice of intention to collect attorneys’ fees has been given as provided by law. To the best of the undersigned’s knowledge, the person(s) in possession of the property is/are Lydia Alcaraz and Andrew N. Sutphen.
The property, being commonly known as 1108 E 32nd St, Savannah, GA, 31404 in Chatham County, will be sold as the property of Lydia Alcaraz and Andrew N. Sutphen, subject to any outstanding ad valorem taxes (including taxes which are a lien and not yet due and payable), any matters affecting title to the property which would be disclosed by accurate survey and inspection thereof, and all assessments, liens, encumbrances, restrictions, covenants, and matters of record to the Security Deed.
Pursuant to O.C.G.A.§ 44-14-162.2, the name, address and telephone number of the individual or entity who shall have the full authority to negotiate, amend or modify all terms of the above described mortgage is as follows: ServiceMac, LLC, 9726 Old Bailes Road, Suite 200, Indian Land, SC 29707, 844-478-2622. The foregoing notwithstanding, nothing in O.C.G.A. § 44-14-162.2 shall require the secured creditor to negotiate, amend or modify the terms of the mortgage instrument.
ATTENTION ALL PROSPECTIVE BIDDERS: On March 1, 2026, the data collection and reporting requirements under the U.S. Financial Crimes Enforcement Network (FinCEN) new Anti-Money Laundering Rule (the “Rule”), found at 89 FR 70258, will go into effect. The Rule applies to certain residential real estate sale transactions (including nonjudicial foreclosures) where the transfer is to a legal entity or trust, and which includes cash purchases, private financing or financing provided by an institution not subject to a federal Anti-Money Laundering or Suspicious Activity Report requirement. As part of this Rule, purchasers and sellers are required to provide additional information and documentation about themselves, their legal entities, and/or the source of funds used in the reportable transaction. The collection of this information and documentation is required to comply with the Rule’s federal reporting requirements.
