AN ORDINANCE OFFICIAL NOTICE Published by Authority of the Common Council of the City of Appleton Office of the City Clerk, Appleton Notice is hereby given that the following Ordinances were adopted by the Common Council on June 3, 2026 and approved by the Mayor on the 3rd day of June 2026. 33-26 AN ORDINANCE AMENDING SECTION 19-86 OF CHAPTER 19 OF THE MUNICIPAL CODE OF THE CITY OF APPLETON, RELATING TO PARKING RESTRICTIONS. (Municipal Services Committee 05-20-2026) The Common Council of the City of Appleton does ordain as follows: Section 1: That Section 19-86 of Chapter 19 of the Municipal Code of the City of Appleton, relating to parking restrictions, is hereby created as follows. This ordinance supersedes and repeals any conflicting ordinance regarding parking in the designated area. Parking be prohibited on the west side of Summit Street from a point 8 feet north of Kimball Alley to a point 6 feet south of Kimball Alley. Section 2: This ordinance shall be in full force and effect from and after its passage and publication, and upon its passage and publication, the Traffic Engineer is authorized and directed to make the necessary changes in the Parking District Map in accordance with this Ordinance. 34-26 AN ORDINANCE AMENDING SECTION 19-86 OF CHAPTER 19 OF THE MUNICIPAL CODE OF THE CITY OF APPLETON, RELATING TO PARKING RESTRICTIONS. (Municipal Services Committee 05-20-2026) The Common Council of the City of Appleton does ordain as follows: Section 1: That Section 19-86 of Chapter 19 of the Municipal Code of the City of Appleton, relating to parking restrictions, is hereby created as follows. Parking be prohibited on the east side of Summit Street from College Avenue to a point 7 feet south of Kimball Alley. Section 2: This ordinance shall be in full force and effect from and after its passage and publication, and upon its passage and publication, the Traffic Engineer is authorized and directed to make the necessary changes in the Parking District Map in accordance with this Ordinance. 35-26 AN ORDINANCE AMENDING SECTION 19-86 OF CHAPTER 19 OF THE MUNICIPAL CODE OF THE CITY OF APPLETON, RELATING TO PARKING RESTRICTIONS. (Municipal Services Committee 05-20-2026) The Common Council of the City of Appleton does ordain as follows: Section 1: That Section 19-86 of Chapter 19 of the Municipal Code of the City of Appleton, relating to parking restrictions, is hereby created as follows. Designate a 15-minute Loading Zone on the north side of Packard Street from a point 50 feet west of Richmond Street to a point 101 feet west of Richmond Street. Section 2: This ordinance shall be in full force and effect from and after its passage and publication, and upon its passage and publication, the Traffic Engineer is authorized and directed to make the necessary changes in the Parking District Map in accordance with this Ordinance. 36-26 AN ORDINANCE AMENDING SECTION 19-86 OF CHAPTER 19 OF THE MUNICIPAL CODE OF THE CITY OF APPLETON, RELATING TO PARKING RESTRICTIONS. Designate a Two-Hour Parking Zone on the north side of Packard Street from a point 101 feet west of Richmond Street to a point 152 feet west of Richmond Street. Section 2: This ordinance shall be in full force and effect from and after its passage and publication, and upon its passage and publication, the Traffic Engineer is authorized and directed to make the necessary changes in the Parking District Map in accordance with this Ordinance. 37-26 AN ORDINANCE AMENDING SECTION 19-86 OF CHAPTER 19 OF THE MUNICIPAL CODE OF THE CITY OF APPLETON, RELATING TO PARKING RESTRICTIONS. Section 2: This ordinance shall be in full force and effect from and after its passage and publication, and upon its passage and publication, the Traffic Engineer is authorized and directed to make the necessary changes in the Parking District Map in accordance with this Ordinance. 38-26 AN ORDINANCE AMENDING SECTION 23-43(g) OF CHAPTER 23 OF THE MUNICIPAL CODE OF THE CITY OF APPLETON, RELATING TO ACCESSORY USES, BUILDINGS AND STRUCTURES; SOLAR ENERGY SYSTEM REGULATIONS. (City Plan Commission – 06-03-2026) The Common Council of the City of Appleton does ordain as follows: On June 3, 2026, the Appleton Common Council amended Section 23-43(g) of Chapter 23 of the Municipal Code of the City of Appleton relating to solar energy system regulations as follows: Inclusion of a purpose statement indicating the ordinance will oversee the permitting of solar energy systems and preserve and protect public health and safety without significant cost increases or decreasing the efficiency of solar energy systems in accordance with state statutes. The amendment includes various definitions and requirements of permitted solar energy systems as an accessory use including development standards (setbacks, height and lot coverage), building plan approval requirements (plan application and approvals), compliance with all other applicable regulations, utility notification and exemption of solar energy systems subject to the review and regulation of the Public Service Commission. This summary is intended to satisfy publication notice requirements of the ordinance's passage and the full text of this ordinance (38-26) may be obtained from the Office of the City Clerk, Sixth Floor, 100 North Appleton Street, Appleton, WI 54911, Monday through Friday, between the hours of 8:00 a.m. and 4:30 p.m., by calling the City Clerk's Office at 920-832-6443 and may also be viewed online as part of the June 3, 2026 Common Council Agenda found at www.appletonwi.gov. 39-26, 40-26, 41-26, 42-26, 43-26 ORDINANCES REPEALING AND RECREATING ARTICLE VI., ARTICLE VII, ARTICLE XII, ARTICLE XV, AND ARTICLE XVIII CHAPTER 9 OF THE MUNICIPAL CODE OF THE CITY OF APPLETON. (Board of Health – 05-20-2026) The Common Council of the City of Appleton does ordain as follows: On May 20, 2026, the Appleton Common Council repealed and recreated certain sections of Chapter 9 of the Municipal Code of the City of Appleton relating to licensing, inspections, and enforcement by the City of Appleton Department of Public Health. Specifically, the sections related to Retail Food Establishments; Hotels, Motels, and Tourist Rooming Houses; Bed and Breakfast Establishments; Safety, Maintenance, and Operation of Public Pools and Water Attractions; Recreational and Educational Camps; Campgrounds; and Tattoo and Body Piercing were all repealed and recreated. The City of Appleton Department of Public Health is an agent program for the Wisconsin Department of Agriculture, Trade, and Consumer Protection ("ATCP") and the Wisconsin Department of Safety and Professional Services ("SPS") for licensing and inspections for the sections affected by this ordinance. The recreation of these sections of Chapter 9 had minimal substantive changes. The changes more accurately reflect current requirements contained in Wisconsin Statutes and Administrative Codes related to those sections and remove obsolete and redundant sections. The changes adopting State laws will not require revisions to the Municipal Code of the City of Appleton if and when State law changes. The recreated sections also provide uniformity and consistency by reorganizing the structure of the Municipal Code of the City of Appleton and creating more uniform and consistent appeals procedures throughout the recreated sections. The State laws adopted in this ordinance include ATCP Chapters 72, 73, 75, 76, 78, and 79, and SPS Chapter 221. Except as noted otherwise, the recreated sections follow the same structure: definitions; application for license and fees; severability; adoption of State laws; summary suspension (if applicable); license denial, suspension, revocation, and conditional licensing; correction of violations and citations; emergency powers of Health Officer; and appeals. Due to minor differences between the ATCP and SPS Administrative Codes, Tattoo and Body piercing follows a similar, but not identical, structure.
