Notice of Mortgagee’s Sale of Real Estate
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Malcolm J. Papaz to All One Credit Union f/k/a Leominster Credit Union, dated September 11, 2013 and recorded with the Worcester County (Southern District) Registry of Deeds in Book 51499 at Page 234, of which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 11 o'clock A.M. on July 2, 2026 on the mortgaged premises located at 33 Barre Paxton Road, Rutland, Worcester County, Massachusetts, all and singular the premises described in said mortgage.
To wit:
The land with the buildings thereon in Rutland, Worcester County, Massachusetts on the Southerly side of the road leading from Paxton to Barre and bounded and described as follows:
Beginning at a stake set in the ground at land now or formerly of one Sperry, said point being Westerly about three hundred and ninety-nine (399) feet of a M.H.B. opposite State Road Station 15 38.28;
Thence by Sperry land, South 1° 35'W four hundred (400) feet to a point;
Thence South 88° 05'E two hundred three and seven tenths (203.7) feet to a point;
Thence S. 33° 53'W eight hundred twenty-five and three tenths (825,3) feet to a point;
Thence S. 88° 05'E two hundred forty-seven and fifteen hundredths (247.15) feet to a point;
Thence N. 33° 53'E seven hundred fifty-four and ninety-five hundredths (754.95) feet to a point;
Thence N. 14° W four hundred seventy (470) feet more or less to the southerly line of before mentioned highway;
Thence by said highway N 88° 05'W two hundred ninety-six (296) feet to the place of beginning.
Said premises are conveyed subject to and with the benefit of easements and restrictions of record, if any, insofar as the same many now be in force and applicable.
Being the same premises convey to Malcolm J Papaz by deed of US Bank National Association as Trustee for RASC 2005-EMX4 dated July 19, 2012, and recorded at the Worcester District Registry of Deeds in Book 49304, Page 359.
Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
TERMS OF SALE:
A deposit of five thousand dollars ($ 5,000) by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check at Cohn and Dussi, LLC, 255 State Street, Boston, MA 02109 within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. In the event of an error in this publication, the description of the premises contained in said mortgage shall control.
